    Hiya!

    I've recently had this with a coupld of banks where they have not replied within the 40 days so I have reported them to the Information Commissioner.

    You can do this here and just fill in the online complaints form:

    Did you make a Subject Access Request under the Data Protections Act? If so, has the 40 days expired? The next stage after this is to let the bank know they're in breach and inform the Data Commissioner.
  • Hi! I'm new at this so bear with me... I sent for my NATWEST bank statements for the last 6 years and now, having received them have come to the conclusion that I don't have the time to go through the whole lot! Is there a company that could help me with this? Of course I would have to pay for this "help" but it would be worth it I'm sure...

    I had a reply yesterday from IC too, appears to be the same as pigsmightfly.

    It doesnt fill me with confidence. Ultimately, the bank can just not send the statements & there doesnt appear to be much anyone can do.:confused:

    Heard back from Barclays today saying that they are unable to trace my account and they want more information!

    I left in December 2003 and although did not remember my account number, I did provide them with date of birth & address as has been suggested - blimey I was with them for 20 years!

    They also said that I had not paid the £10 fee - but I was told in their initial letter acknowledging my request that they would not charge me :rolleyes:

    Any advice on what I do now please - do I forward this letter to the Information Commisioner or write to them again? :confused:

    hi can someone please advice me on what to do next, i sent letter 1 to Halifax 20th Feb (40 days up saturday) and after numerous calling into the Bank, as of yet i've still no statements,
    wednesday received letter saying that they've ordered them and that i should receive in next 10 days. can you tell me as to what the next step i should take as 40 days are up. i already sent letter stating that i haven't received them, as i can't use the template asking for money owing as i don't no how much (alot no doubt)
    next ? Americian Express have said that they are not paying the £160 charges cos the charges applied to account were clear properly disclosed and could have been avoided if i complied with Terms and Conditions.Then it goes on to say that the OFT in April 2006 said £12 was to much in July 2006 they dropped there charges to £8 therefore there previous default charges will not be amended.
    shall i send letter saying taking them to court?

    It wouldnt hurt to give Halifax the remaining few days to get the statements to you but I wouldnt allow any more than that. You can complain to the Information Commissioner any time after the 40 day period is up though.

    As regards American Express I advise to carry on and follow the process. The charges are reclaimable and this is a fob off. If their charges are lawful they wont mind turning up at court to justify them there will they ;)

    I am helping my step-dad reclaim his bamk charges from lloyds. I sent letters to Natwest (my bank( and Lloyds (his bank) on 21/02/07 and I got all my statements back on 16/03/07.
    My step-dad had a letter on 28/03/07 stating that they would be taking another $ WEEKS to be able to give him the info he needs - I sent the £10 cheque and the letter from here. I just want to know if they can do that or are they just threading him along?
