I am after some help please,
I have sent the first letter to HSBC asking for my charges for the last 6 years with a cheque for £10. It is getting towards the end of the 40 day period to reply and the cheque has not been cashed and I have heard nothing. What can I do if I get no reply? Also, anyone with HSBC, is there anyway I can view this info online?

Just an update for those who have complained to IC. I havent heard anything yet. Although, as I didnt get an email notification of my enquiry (like i would normally expect), I can't recall the actual date I complained.

Does anyone know... is it 40 days from when the bank cashes the cheque, or 40 days from the date its recieved. My bank didnt cash it for 3 weeks after I sent it.
If this is so, they are playing for time.
i went into my branch today and asked them for their phone number and told the cashier why. She smirked at the cashier sat next to her, and they both looked at me smugly..
I thought, you might well snigger, but this bank owes me thousands, you wont be sniggering when I have the money in my hand ladies.
How dare they look down their noses at me, with a holier than thou look on their faces.

I still haven't received an email or letter or anything from them yet and it been nearly 2 weeks now.
I too thought I would get some sort of confirmation that they had received it and were dealing with etc, etc.
Am thinking about sending a letter to them to check they have recieved my complaints as I had complained about 3 banks and don't want them getting away with my money!0 -

I know there are a few of us that have eagerly been waiting for replies from the IC after making complaints to them about banks not responding. I've just had 2 replies from them about 2 complaints I made. They are as follows:

Complaint about the 'Subject Access Request' made to Capital One for personal information relating to bank charges.
Thank you for your correspondence dated XXXXX.
You have complained that, as yet, the information requested from Capital One has not been received.
When we receive a complaint like this, we are under a duty to consider if it is likely or unlikely that there has been a breach of the Data Protection Act 1998 (the Act). We will then decide what action, if any, to take.
Following a recent Office of Fair Trading decision about 'penalty charges' we are aware that the number of individuals making subject access requests to financial institutions has significantly increased. However, clearly these financial institutions are still required to comply with subject access requests within the statutory 40 calendar days.
As you may be aware under the Act there are eight data protection principles. These are sometimes known as the principles of good information handling as they set out the way organisations should handle personal information. The sixth data protection principle requires organisations to process personal data in accordance with an individual's rights under the Act. Therefore if you have not been sent the information you are entitled to within 40 days, it is likely to be in breach of the sixth data protection principle
We would like to explain that due to the number of complaints we are receiving about failed subject access requests we are writing to financial institutions on a monthly basis, sending them a 'batch' of complaints.
We will be writing to Capital One with the next batch of complaints at the end of March 07 and will of course include the details of your complaint in our letter. We will advise Capital One to ensure that they provide you with the information you are entitled to as a matter of priority. Furthermore we will ask them to outline what steps they are taking to ensure their future compliance with the Act. Therefore although we will now close your case we would like to assure you that we will continue to carefully monitor this issue.
Finally, it may be helpful to explain that a breach of one of the data protection principles is not a criminal offence and we cannot punish an organisation for a breach of principle. Our priority is to get organisations to take steps to solve the problem and to ensure they handle personal information properly in the future.
However, it may also be helpful to explain that if you have suffered a loss because an organisation has broken the law, you may be entitled to compensation. We do not have any powers to award compensation and any claims should be made through the Court.
We would like to thank you for bringing this matter to the attention of the Information Commissioner.
Please quote the case reference number from the top of this letter in all future correspondence about this matter. Failure to do so may delay the processing of your complaint.

hello all can any one help me please,
i sent off for six years of accounts in mid feb the money went out of account a week later,
ive waited the 40 day well over this still no accounts,
so i rang them up and all they said was "that it was been delt with but because of all the media coverage that they have a back log should be with me soon",
but did not say how soon lol!
what should i do now just sit on it for a few more days or what.....
any replys of help would be great

According to posts I've read about HSBC, if your sister has online banking with them she can access the full 6 years of her account online. Hope this helps

My Partner has 2 accounts with HSBC 1 is her own and the other is a joint 1 with her ex hubby,we requested both lots of statements...and surprise surprise they sent the joint account ones(the one account that hasnt been touched/used for over 3 years)...as for the other accounts statements nothing....avin read this post i have a smile on my face again...do i have to download n print the statements off or just take a note of the dates n ammounts of charges?0 -
I wrote for my statements of charges for the last 6 years on 27th Feb with the £10 cheque. As yet I've not heard anything and the cheque has not been cashed, although it seems a lot of people on here get responses from HSBC within a week or so.
Rang telephone banking tonight and they said I had to wait until 40 days after I posted it before ringing back, as only then would they look into it.
Anyone else had such a delayed response?

Hi there!!
I aslo bank with the HSBC but registered for internet banking and am able to view all statements on line, I sent my 14 day letter and a copy of the statements attached on 16th March and today received a " were dealig with your complaint" letter and a brochure!. Im giving them till Monday 4th ro reply and then Im off the small claims court!
