I have today received a letter from Lloyds TSB stating that they are investigating my complaints, and that although they are aware it has now been 4 weeks they have not resolved the matter and will be writing again within the next 4 weeks with either a response to my complaint or an estimate of when I can expect it.

    I am a bit baffled, as so far I have not lodged a complaint, but have only requested the bank statements.

    I rang Llloyds TSB this morning to question what complaint they were investigating, and they just rambled on about them looking into my complaint to get back my bank charges. By the end of the conversation, I was no further along then when I started the converation.

    I do not know what to do next, and would welcome any advice.

    You have received what is becoming typical responses. They are deliberately choosing to log it as a complaint in anticipation of you reclaiming bank charges thereby following their own timescales and procedures. This is not acceptable.

    I advise you write back recorded delivery reiterating that you have made a Subject Access Request under the Data Protection Act 1998 and as such they have 40 days to respond in full. Deduct any days passed since you sent it and they are likely to have received it and demand receipt within X amount of days left. If you do not receive them in the 40 days you can complain to the Information Commissioner about the breach.

    i am helping my brother to reclaim his bank charges, so far the first letter has been sent and today he received a letter from the bank, there were sheets detailing when charges occured and what they were on from 2005 onwards, there are no details of how much the charges were which was requested in the original letter and there are no charges detailed from 2001 to 2004 which he says he is sure he must have had some in that period, from 2005 to date they have listed 34 charges. The bank say to look further into their archived files will cost him and they have said they have already taken a £10 charge for what they have done so far. What should i do now as i cannot send the next letter requesting a refund amount as we dont know what it is, we do not know of any charges details pre 2005 and to get them will have to pay, should we go to the financial ombudsman and see if they will take it up, also is it right to be charged for this information from the bank?:confused:
    Any advice much appreciated.

    I would write a further letter pointing out that you are not asking for statements per se but information from the data they hold in connection with the relevant account/s. They are required to provide this information to comply with section 7 of the data protection act 1998 for which the maximum chargeable fee is £10. If they fail to comply, in full, following this explain that you will refer the matter to the Information Commissioner who could seek prosecution of the bank and award compensation to you/your brother which may exceed the actual potential amount of charges claimed back. Make sure that you identify to the bank the data that they have not supplied ie the amount of the charges and the missing period etc

    Hi No,

    I called up and asked for the last 6 years worth of bank statements. They have charged me £5.00 for this.

    I am going to give them till Wednesday of next week to have them. If I don't get them what can I do.

    You do have to the give the banks 40 days for this information/statements and they may come out in batches but if you receive a standard letter from the bank which suggests a different timescale from the 40 days, complain right back.

  • firstly let me appologise if this question seems long winded, but to be honest i am not sure where to start!

    So... i have been banking with Barclays for about seven years or so, first year virtually charge free. After that because i am self employed and, getting paid for jobs is sometimes slow, i found myself beyond my overdraft of £800.00 on a regular basis, and as i had direct debits paid out i found myself charged sometimes as much as£150.00 per month for letters at £30.00 per time. It got to the point that i could no longer pay enough to cover any of my payments or pay the bank back, and to cut a long story short and after being called sometimes up to six times a week by Barclays about how i would pay the arrears on account and , even being threatened by them to take my home from me, i ended up with a letter informing me that i was being taken to court and was served papers to this effect for the sum of £1149.49.
    I sent letter to barclays printed directly from MSE asking for details of charges for the last six years enclosing a cheque for £10.00 and contacted court via moneyclaim.gov informing them of what i had done, this was on 21.02.07 i recieved reply from court on 22.02.07 informing me of a stay.

    Then on the 04.03.07 i recieved letter from barclays stating that they would not be sending me the details of charges but copies of statements for which just this once they would waiver the charge and returned my cheque, and , as these records were stored manually rather than on computer that this may take a bit longer .

    THEN... on 22.03.07 i recieved another letter from Barclays saying that without admission of any liability they were prepared to withdraw the action from court and agree not to pusue me in respect of the sum claimed and attached copy of notice of discontinuance that they lodged with the court, FANBLOODYTASTIC you might say, BUT, I am not sure what to do now.

    I have had a rough tot up of charges from old statements, as Barclays have not yet sent me copies, and i reckon they owe me approx £5000.00 in charges.

    I posted first letter to them on 21.02.07 which means the forty days is up so , does the forty days apply to weekends, or are we talking working days,as this time is up and i have not received the statements do i contact the imformation commissioner, or proceed to the second letter detailing the amount i think they owe me?

    I know i have actually got a result in them dropping the court action, but after the way i was bullied on a daily basis reducing me to tears on several occasions i feel i should now stand up for myself and get back every penny i can , i am sorry if i have taken too long getting to the question, but wanted you to have background info.

    I look forward to any advice you have to offer, and would like to thank you Martin for giving the nobodies to the banking world a way to fight back, THANKS
