I have sent the first letter requesting my statements to Nationwide after 40 days they have not replied. I have informed the information commissioner they have not replied just yet.
What is the next step nationwide have had now nearly 50 days!!!!!

Write to the bank telling them you ill be taking them to court for non complaince of the DPA unless thye give you the information in 7 days....and remind them you have complained to the ICO.

Iv been following the main site guide to reclaiming charges back.
I started with the template letter to recieve a list of charges for the past 6 years, i sent this in January.
I had no reply after 40 days, so I went into my branch. I asked there about it and they seem to have recieved lots of these claims. Thier answer to why i have not recieved a reply is that as i never addressed it to an employee of the branch it goes to an other office where there are people dealing with the claims. They also said that there is no 40 Day rule and they dont know where the "media" got this from!!
So i sent an employee of the branch a copy of the letter and have so far not recieved a reply!!!
My next step is to call the branch tommorow, but id like to get some advice on here on where i stand.
Its a Royal Bank of Scotland account.

Data Protection Act - (8) Subject to subsection (4), a data controller shall comply with a request under this section promptly and in any event before the end of the prescribed period beginning with the relevant day.
(9) If a court is satisfied on the application of any person who has made a request under the foregoing provisions of this section that the data controller in question has failed to comply with the request in contravention of those provisions, the court may order him to comply with the request.
(10) In this section-
"prescribed" means prescribed by the Secretary of State by regulations;
"the prescribed maximum" means such amount as may be prescribed;
"the prescribed period" means forty days or such other period as may be prescribed;
"the relevant day", in relation to a request under this section, means the day on which the data controller receives the request or, if later, the first day on which the data controller has both the required fee and the information referred to in subsection (3).LegalBeagles0 -
OMG do the banks think their customers are stupid? :mad:
Has anyone else received a letter after 40days from the bank claiming 'despite their best efforts they have not been able to get the information provided and I can expect a responce within the next 4 weeks OR an estimate of when to expect my statement of charges!' With the change in law looming it seems they are doing their best to pass the claim on to 'made up' departments too!
I bank with lloyds and the letters have a customer service recovery department contact number that never actually rings its just constantly engaged - is this a real number I wonder? I makes me so mad that they are so quick off the mark to take your money but it takes them over 40 days to return it. I've sent this letter in responce to the letter I received this morning:-
To Whom It May Concern:
In response to your letter dated 14/03/2007 I am appalled to hear that having paid my statutory £10 fee, you have not provided me with the 6 years of bank statements as is my right under the Data Protection Act within the required 40 days as is stipulated under the Act.
If I have not received the requested bank statements as requested on 12/02/07 within the next 3 working days from the date of this letter I will have no alternative but to report this breech to the Information Commissioner.
Furthermore ,due to your obvious delaying tactics thus far if I have not received the requested information within 7 working days from the date of this letter, I will not only be reporting the breech but I will also be charging you interest at a rate of 8% on any monies owed.
I look forward to your immediate response.

Annoying I know but please dont stress, stress kills and it sneaks up on you to do it.
Hanging on for the OFT report isnt going to change the fact you can reclaim your charges so its their loss ultimately. Yours will be one of a million frustrated letters they receive and ignore so please relax. Play the waiting game, you will win in the end

Lloyds have also told me after I sent my second letter that they are hoping to pay all my charges back into my account within 30 days after i specified 14 - delay tactic? probably - I am about to proceed with legal action for me and send my 2nd letter off for my other half.0
