    Knowing how difficult the process has been to date I am assuming that my statements will not arrive within 40days.

    What is my next step if HSBC stall me further?

    When the 40 days is up, write and let them know they're in breach of the Data Protection Act. Let them know you will be informing the Data Commissioner and enforcing the request through the court if necessary. Then write the the DC. This should hopefully get things moving.

  • I sent a request to the coop bank on 1st march .I sent it recorded delivery and they recieved it on the 2nd march .
    Ive just phoned them as ive not heard anything from them although its only been 17 days now only to be told that they can't find any trace of my request even though Royal mail have confermed it was signed for .
    Further more it took half an hour of being put on hold to find this out .
    And their response was ............ "Can you send the request in again ??"
    I told them that they only had 23 days left in which to supply me with the infomation they requested and all they could say was " you'll have to send the request in again and it will be 40 days from when we recieve it "

    What should i do ???

    Send the request in again or write them another letter telling them it's not my fault that the request has been lost and that i regard the 40 day period as starting from when they originally signed for the first letter ???
  • Hi. I got a account with loydss. wrote a letter, got the standard reply.The couple weeks later received a proper reply with the info that i would get the statements within 3weeks. I havent received them although the times past. What do i do now.

  • Hi All

    I have a problem I wrote to the nationwide on the 28th January requesting all statements etc...etc.. Nothing received from them. then their 40 days were up on the 10th of March. Still nothing (all letters were sent recorded post)

    Have just informed the information commissioner. Does any one have any advice for me on my next step or dhall i just wait for the information commissioner to get back to me.

    You do have the option of taking them to court to force compliance.... have you written to the bank again since the 40 days expired ????? Do so and tell them you have complained to the ICO and are considering an application to the courts.

    i sent a letter to my bank way over 40 days ago now and have just realised that they should have sent a reply by now.

    i'm about to follow up with a phone call after this post, but was wondering, once i got onto the Information Commissioners Office site i couldn't find where to go regarding bank charges, could someone help me with this?
