OK, firstly did you send you letter by registered post? These requests sometimes get 'lost' if they're sent by untraceable means.
If you are sure that the bank has received them, but has ignored the request and you have given them the 40 days, you can let them know they are in breach of the Data Protection Act. Let them know you will be informing the Data Commissioner and enforcing in the request in court if necessary. Then inform the DC.0 -
Has anyone actually complained to Information Commissioner???
I just submitted my online complaint with attachments after Natwest failed to send statements for one of my accounts. I asked on 12th Jan originally. Sent follow up letter 28th Feb, phone call week after, & now complaint.
Wondered what the outcome is likely to be... any ideas???0 -
Hi I was wondering if anyone can help, I have sent through my £10 and asked for my statements(the 40 days was up on the 6th March) I did get a letter 2 days before the 40 was up saying it would take longer so I tried calling but no luck so I sent an email, still nothing I have just sent through a letter saying that I am entitled to my statements and that they were in breach of the 40 day DPA, I have said that I will give them 7 days to send them to me but I don't know what to do if they still don't send them? any ideas anyone??0

If they still don't give you the information you requested you should report them to the Information Commissioner. Here is a link to the Data Protection complaints webpage:

You have given them ample time to respond so don't hesitate in doing so.

I'm trying to get my money back from Abbey National, I did phone up the banking ominbudsam(????!!) to see if I could put a complaint in as they hadn't responded but she was just saying(not exact words mind) they are really busy and its your fault you have got the charges, she said that I could put a complaint in she would send me the details but said they dont send it off until the end of each month and this wasnt going to get my statements through any quicker (not very helpfull)0

I'm still waiting to hear from my bank and get my statements from them, they have not cashed the cheque yet, but they still have about 20 days left.
But what happens if it gets to 40 days and they still haven't replied?

I ordered my statements 38 days ago from HSBC.
I called the bank 19 days after ordering the statements to find out when they would arrive. I was told they couldn’t find my request – eventually they re-ordered them and would use the 40 days from my original request.
I called again on the 32nd day after ordering the statements only to be told that they had just been ordered that day.
Each call has been a real battle to get any information..
Knowing how difficult the process has been to date I am assuming that my statements will not arrive within 40days.
What is my next step if HSBC stall me further?
