  • Hi I sent LLoyds bank the 1st letter for my current account and also for my (now closed visa card) a week after the 40 days I have recieved a letter re my current account with statements to sept 01. in the letter it says that if I need further statements then this wil take longer to access archived data.

    It requests a reply and says that under the terms of the data protection act it has 40 days to reply with the missing statements is this true (I think not as I already waited 40 days) but what can I do about it?

    Integrity - you will need to tell them you have waited the 40 days and now you will report them to the ICO for non compliance with the DPA.

    No harm in writing back saying in response to their letter, the only thing you requested was 6 years worth of charges etc etc and that you still await these. Also that you would like confirmation that your request is being dealt with and when you can expect to receive the documents you have requested.

    I don't know what their game is but it won't hurt to keep the lines of communication open.

    I posted my first letter (statement request) to Barclaycard on the 25th Jan and have still not received the statements, what do I do next?

    I also requested statements from Abbey and they have started to send them one by one, is this right?

    It will be a standard holding letter they are sending out but no harm in phoning and asking where the info/statements are although they do have 40 days to produce this.

    Barclaycard are definately the worst for delaying, do both of these...

    Some banks will send the statements out in batches or even one by one!

    Morning

    Apologies if this has been done before. I'm just wondering what actually counts as a "response" from your bank after the initial statement request letter has been sent?

    I wrote to Barclays on 21st Feb with the step 1 letter. I got a letter back from them (no date on the letter, but envelope stamped 26th Feb) stating that they would supply the statements for free this time, so returned my £10 cheque. The letter also stated that they would provide me the information "within the next few weeks".

    So my query is this. Does this letter count as a "response" meaning that they have complied with the 40 day rule so I just have to wait until they deign to send me the statements? Or are they obliged to provide the documents within the 40 days? I'm at day 30 now, so still time left.

    The information requested under the Data Protection Act should be sent within 40 days. So their 'response' does not fulfil their obligation.
