Thanks Pigsmightfly -(I did try using the thanks button, but I kept going to the top of the page).
I sent my complaint using the online enquiry form and it did say I will get a reply, but not when, although I appreciate they must be inundated.
I suppose we just keep checking to see if anyone can help.

The only other thing I can think of doing is calling the helpline on 01625-545745 but as you say they probably have complaints coming our of their ears! :rolleyes:

Wrote to the bank requesting the amount of charges I have paid using the template letter and sent £10 40 days now up and had a letter from the bank saying they need more time and it will be another 40 days what do I do now can anyone help. Thanks0

I was told that if the charges are over £6000 I need to go straight to the crown court.As my charges are over this limit can you please clarify me on this one.
Also Abbey (my bank) as not produced my statments of the last 6 years as requested by me and everytime I ring them up they came up with a different excuse , the last one they claimed they mailed them to me although I have not received anything ,when I told this to them they told me to check with the post office(???).Can I send them a letter stating that if they dont produce all the data they held with my details I will complaint to Information comissionary officer.
Please can you clarify me as my charges are quite high and really would like to get my money back.
Your help in this matter is much appreciated.

i requested copy statements on the 09/02 as yet i have only had a response from barclays to say they will forward the statements shortly,that was on the 22/02.
does anyone know if they bank has 40 days to send a response or if they have 40 days to send the statements.
ie can i complain to the information commisioner although the bank sent a response on the 22/020 -

I have recevied replies from Barclaycard and Lloyds TSB but thye have not provided teh full 6 years on some of the accounts and no details on some accounts. barclaycard said they will provide tehm as a goodwill gesture then charged my card acocunt £10 - thats not free goodwill in my book - and tehy wont refund it - even thoguh i have it in writing tehy will do it free.
Now i know i can go to the ICO for a breech, but does this include the above scenario where some of the inof has been supplied.
they have had the comply within the next 7 days letter aswell and nothing further has come from them.
Also can i put a small claim in via county court for the breech for compensation for the extra work - if so what is an acceptable amount to claim.

Hi all,
Not sure where to go about this one, so advice would be much appriciated.
I got a first response from Abbey National on the 10th of March. Just 7 days after asking for my statements. This was a formal letter confirming my request, and to say that they were going to take £10 from my account to cover there costs for this. However, they stated that i'd have my statements in 12 weeks!!. Some 44 days more than they're allowed to take to get back to me on this!
After recieving this letter, i've had 3 polite phone conversations with them. I've stated that they've got until 19/04/07, but they were adement on all 3 phonecalls that it would take this long because they have such a huge backlog of these requests.
I stated that me being the customer, that abbey nationals workload, and/or staffing issues are not a concern to me, and that i require these by 19/04/07 once the 40 days are up.
They don't seem to be budging on the matter though! I've been promised a transfer to a team leader/supervisor on my first two phonecalls, and then just to be told there is none available! Which gets to the point where i'm promised a call back. However, both times I was given a name of a team leader that no one has even heard of!
The whole thing is getting to be a joke to be honest. I've got my letter to the Information Commisioner ready to post tommorow. Any other action recommended?!0 -
i posted 1st letter to Halifax on 20th Feb as of yet have not heard anything, went to bank at weekend they said they have not got anything on the system to say that they have received letter but i've noted on statements that they have took £10 out of account.
however i don't think that i put date on letter but i no when i posted it,
can you tell me if the 40 days still counts0
