    Hi guys

    I made a claim through MCOL against Barclays and there haven’t issued any acknowledgement. The 14 days ended so I have just (this morning) filed for judgement by default. You can either put payment immediately or by a certain date. I have put by 21st April. Is this reasonable? What happens now – anyone been in this situation?

    I've just started entering the competitions (July 07). When I win I'll update this signature. Look on the bright side, I shouldn't have to update it very often.
  • I am currently trying to reclaim bank charges from Barclays. I initially wrote to the bank claiming for just my charges no interest and was offered £300 but as the charges came to more than double that amount, and after following Martin's advise :money: I declined the offer. I thought they would have made a more realistic offer at the threat of court action but they did not and I am now at the stage where I have initiated court action and Barclays have filed an acknowledgement stating they will defend the whole claim. I was convinced that they were just stalling and that in 28 days time they will not respond and I will file a judgement against them and hey presto! :j get my money......but now I am not so sure! I have read a couple of threads on here about people having to actually appear at court, particulary with Barclays (it looks as though they are playing it tough!).

    I just wanted to know what other people's dealings with Barclays have been? Has anyone been to court and Barclays actually turned up? If so did they win? Has anyone taken Barclays to court and actually got their money? As I am also worried that Barclays will not turn up, I win but then Barclays still not pay and i'll have to send baliffs in etc???? It all sounds a bit crazy when it gets to that stage!:eek:
    Why are barclays being such a tough cookie???? Are they fighting all their cases? :confused:

    Hi DJF, Barclays never replied to my 1st letter either, so when the 14 days was up (gave them couple more days for easter too) I sent off my 2nd letter informing them they got 14 days to pay up or will take them to court, dont hang around, they had your cash long enough, time to claim it back, it seems that Barclays do take there time with these things, so just hang on in there.

    To be honest I am not suprised you thought like this having read the articles on this site...it doesnt happen like that and even if you get default judgement you'd look at set aside hearings and warrants, so honestly a defence is the best result !

    Once the defence is submitted, you'll get an allocation questionaire from the courts with a copy of the defence. Some courts have done away with AQ's for bank charge claims so dont worry if you dont.

    Then its return that and wait for a court date...barclays are currently settling a few days before a full hearing date, so dont worry at all its completely normal and its very doubtful you'll ever get to see the inside of a court room.

  • they appear to be fighting all claims. I spoke to someone in their Canary Wharf office who claimed that they would usually look to settle the claim before the court hearing and not to worry. A few days later I received a defence filed by the same person defending my whole claim. I'm prepared to go to court though so will let you know what happens.

    Well good luck with your claim, be nice to hear how you get on, i'll keep you updated 2..Barclays have 28 days from 13th April so looks like it's the waiting game for the time being!

  • Barclays have just announced intention to defend...1 day before the deadline (i.e. after 27 days).

    Oh well,next step I guess...

    Hi can anyone please help.

    I have on my statements paid referals, but only at an amount of £10
    Can these be claimed even thugh there as little as £10?
    Also I have some stated at "upaid outs" 1 @ £30......
    Can these be claimed also? Im guessing these are when not enough funds been in when a direct debit has been due etc.

    And if anyone has the address where you send the 1st letter requesting the money back to

    postcode , I believe this is correct address, but if anyone has the postcode and can confirm the above, would be very grateful.
