    Hello All,
    Sorry if this is a silly question, but can you still claim if you have a graduate account? My friends have said that you can't.... help!!!

    Phone and say your requesting your statements under the Data Protection Act...Should cost you no more than a tenner...Look at the template letters on this site for exactly what to say....theres a template letter to send to your bank/cc company...

    You need to use the letter 1, from Martins "Reclaiming Bank Charges Step by Step thread" requesting any info they hold on you under the dpa. If you have asked for copy statements, they can charge. It is generally the statements that they send though, and they are just being difficult.
    Monument were v quick to respond to me, they offered £240 of a £480 claim which I have rejected and am waiting to hear their response.
    Send the letter, keep copies and you'll be fine!

    Court costs you money...Ombusman doesn't...Court awards you full amount +interest...Ombusman, who knows...Length of time it takes to do either process is upto 6ish months i reckon..Courts dates for hearings are AGES away and i'd imagine the ombusman aren't that quick either...

  • I phoned Barclays yesterday (40 days up on 18 April), just to enquire if they had sent the statements yet. Told by young girl that they had 40 calendar days to respond, I said yes I know, but they are up on Wednesday, and if you haven't sent them out by now, I doubt I will get them by Wednesday. Was then put on hold for 15 minutes, as the department I needed to speak to was busy. Put the phone down after 15 mins, nobody came back to me, and for all I know, I could still be waiting now ......

    Phoned again this morning, told by a harrassed sounding lady that they had 40 WORKING days to reply, told her that this was wrong, and that it was calendar days. Repeated the above and told her I would be reporting them to the Information Commissioner if I didn't get them. Was put on hold for 5 minutes, then told they had been sent out on 10 April. We will see .....:rotfl:

    Post came this morning, as expected NOTHING from Barclays. Phoned the Leicester number 08457 555 555 and spoke to a lovely lady. She confirmed that I should have had the statements by now, would send me duplicates and confirmed that Barclays waive the £10 change. She said she couldn't understand why I hadn't had correspondence from them (overwhelmed I suspect)! Lets see if THESE statements show up this week ........

    Does anyone have any advice?!

    I have completed the MCOL against Barclays for £702.30 including interest and court fee, their time is up on 23rd April and then I can enter the judgement (I'm sure they'll defend though, as looking through the site they tend to at the eleventh hour).

    Yesterday I received a letter from Barclays offering to pay £410 towards the total amount I am seeking - realistically I would accept £630 which is the charges plus court fee (no interest).

    I was thinking of ringing them to put this to them. Has anyone else tried this and succeeded? If they don't budge, I guess I'll just progress with the court procedure.

    Any advice would be appreciated.

    CHECK THIS OUT GUYS

    I asked barclays why my ACCOUNT FEES were at £11.50 and was told that they included the cost of extras like 'car breakdown cover and personal injury cover'. Itold them that i had not asked for this and did not need them as i have cover of my own. They said that it shows on my statment that i am paying for it and i told them; "no it doesnt, it say account fee not car breakdown cover and personal injury cover". Ithen asked them to provide me with strict proof that i agreed to the costs in the way of a hard copy of a contract with my signature on it. They have failed to do so, and have now sent me a letter saying they are refunding me £129 for the last 12 months fees. RESULT

    Worth checking out.
