thanks for your reply, it makes u feel better when someone is in same boat, we're trying claim about the same amount. Scary isn't it
  • After having taken Barclays to court and being informed that they will have been served with papers on 7 April 2007, I received a "good will gesture" letter from them on Easter Saturday. I am trying to claim £3,700 with interest (£2,900 without). Barclays have offered me £2,200 as a "good will gesture" but have also registered an acknowledgement with MCOL. This has now granted them 28 days (compared to the 14 they would have had, had they not acknowledged) to gather a defence case together. Is this just another step in the dance? I'm worried now that if I don't accept their offer, I will be dragged through a long and drawn out process with possibly little gain at the end. Any ideas?

    Many thanks, Velma x
  • Its the hassle vs gain scenario. what is important to you? getting all the money back with a fair amount of hassle. or settling quickly, taking the money and running? 2,200 isnt bad on a 2,900 claim... BUT, that still includes a fair profit for ther bank which is your money. If the thought of a long and drawn out process fills you with trepidation, then perhaps it isn't for you. It's 2,200 more than you started off with, so as Noel Edmonds says, its REAL money. Bit of a deal or no deal. Will you deal? Let's see after the break...........

Just a quick question to anyone who has seen it all the way through.... How long do you usually have to wait for a court date once you have filed? And then when (in your experience) do Barclays pay out? Is it literally the day before the hearing?

I have asked the same question a few times. It seems it varies depending on how busy your particular county court is. The county court my case has been reffered to cashed my £100 cheque on the 4th April but havnt set a date yet.

can anybody advise me on whether to take an account with a bank or a building society, done lots of reading, but think I must have read to much as everything seems gobble-de-gook, also can you just open an account without having stuff paid into it, not sure whats the right way to continue, have sent my letter giving Barclays 14 days otherwise Im taking them to court, must admit getting nervous now, but determined to see it thro.

  • ginger.... basic bank account. Also, i applied for an alliance and leicester current account as a parachute, i obviously didnt qualify for the proper one where you need to put in 1000/month, but they gave me an equally good account with visa electron card/chequebook etc etc internet banking etc AND i dont have to pay a specific amount into the account each month. But dont neccesarily take this as a reccomendation for A&L as ive only had the account 1 week lol.

  • Hiya I'm at exactly the same stage as you with Barclays - haev received an acknowledgment from the that Claim has been served, they now have a further 14 days to enter their defence - looking through money saver expert it seems that they do go that far as to entering their defence , but haven't come across anyone who has actually gone to court with them. Please keep me posted.

I haven't been keeping up with all thats going on with the messageboard the past few weeks and I've blown it big style but I'm back and raring to go, again!

I have been claiming, on behalf of my husband, about £320 (I don't have the paperwork with me!) this has been going on since November.

We have received notification that they aren't going to budge with our claim and we aren't entitled to anything.

I have done the first two letters and spoken to someone at Barclays who confirmed that they won't budge and she recommended I go to the Ombudsman.

Should I do this or should I start proceedings for court?

I keep thinking 'is it worth it for such a small amount?' but that's been my attitude for the past few weeks about tons of stuff and to tell you the truth, its got me quite down.

    Thanks in advance
