From what I hear, it is quite common to get another ESA50 in the post shortly after a successful appeal.0

Sorry, I dont fully understand ESA but how come you only get £97 per week?If you tell the truth you don't have to remember anything. - Mark TwainNappies and government ministers need to be changed frequently and for the same reason0 -

It is now 99.15 per week, and was 94.25 before that.
OK thanks, I'm out of touch with all the different ratesIf you tell the truth you don't have to remember anything. - Mark TwainNappies and government ministers need to be changed frequently and for the same reason0 -
Of course these things will happen. Nobody is suggesting that ATOS or the DWP are always right. Neither can it be said that all IB, ESA and DLA claimants are as genuine as the driven snow!
So there has to be a system that is intended to snare the benefit cheats and in the process some innocent people will get caught up in the cross fire. It is called collateral damage.
The question of regular retesting has to take place, how would the DWP find out who is or is not entitled to benefit on a regular basis.
History so far has told us that the Government cannot rely on the honesty of the general public. How many DLA claims were/have been accepted and granted on a 'for life' & 'indefinite' basis.
How many of those have voluntarily told the DWP that they have improved and don't need DLA anymore?
Likewise with IB, claimants were left far too long without being retested.
Don't blame the Government or ATOS for what is happening. You should be looking to the benefit cheats that have caused this system to be employed.
One of the problems with this site, is when they PPR obvious trolls like the above, many times their posts are left behind.[greenhighlight]but it matters when the most senior politician in the land is happy to use language and examples that are simply not true.
[/greenhighlight][redtitle]
The impact of this is to stigmatise people on benefits,
and we should be deeply worried about that[/redtitle](house of lords debate, talking about Cameron)0 -

I've got the atos thing tomorrow. I only get £71.00 a week as it is.

Judging by this thread I've got no chance at my Atos medical which is due in a few weeks.
I had cancer last year and am hopefully cured but will be checked for 5 years. For about a year now I have been unable to walk more than 10 yards before having extreme pain in my legs and having to stop and rest. I also suffer from extreme fatigue only being able to last about 3 hours before being exhuasted. I am aslo diabetic and have numerous other medical problems. My doctors are trying to find the cause of my walking problems and cronic fatigue. On average I have to attend 2 appointments a week often at specific times.
I wonder how an earth I would be able to hold down a job (if I could get one) and how they would put up with me having to take so much time off.
Also, when you sign on for jobseekers aren't you agreeing that your fit and able for work?0 -

Your worrying to much, you won't get put straight onto JSA there will be an appeal with an independent tribunal.
Also you can do things that will help:
1/Ask for the medical to be recorded or do so covertly [if they catch you they stop the medical.]
2/You can take in a representative with you to take notes.
3/Forget about the medical and concentrate on your medical evidence, match each piece of evidence with the relevant ESA descriptor and send it in to the decision maker recorded delivery.
4/You can request a home visit if your Doctor agrees you cannot physically attend the medical. They will also send a Taxi in similar cases.
Do you have strong medication? Don't forget to include their side effects as part of your evidence.
The problem is that people go into this with their eyes closed and expect things to be 'fair'. This is not a crusade against benefit cheats it is a no holds barred attempt at reducing the amount of claimants, whether genuine or not. Ironically it has ended up a big ugly mess, most likely costing the tax payer MORE money in paying ATOS fees and propping up, with huge sums of money, a desperately wobbly tribunal service which is being drowned in a wave of appeals.
They also cut the funding to charities and organizations that help disabled and vulnerable people with their claims at almost EXACTLY the same time as they completely changed the benefit system. Sound fair to anyone?
It's what the politician are best at- dirty politics and smokescreens to cover their own abysmal failures with the economy.

- but it was indeed LMC not BMC - now amended
- the BMC themselves seem to have a 'comfy' acceptance of ATOS originated complaints
