Fuming about atos medical

    And there are certain people on this forum who think ATOS can do no wrong!!

    Im going to an appeal on Tuesday, I dont want to but I did go to the medical and I posted about it here about the way we were treated then, I did the submissions for the appeal (and because I cant use a pen/type due to disability and my speech soft wear has a glitch so it took forever) so I will see if the complete and utter lies in the report are believed or not by the tribunal.

    I will post about the results after the tribunal, Im really worried about my husband after this experiance, hes currently in the support group but he's just done another ESA50 though since his recent stroke he's too unwell to even leave the hospital or home and we are waiting to find out if he need surgery to take the clot from his brain.

    Good luck with your appeal. Do you still have to fill in ESA50 even if you are in the support group? My husband is in this group as well, dont think we could go through all the hassle again. Im so sorry to hear that your husband is very ill and I hope that he is on the road to recovery very soon.

    Its not my appeal, I gave a friend a lift on condition that they got my powerchair in/out (I cant stand/walk so I cant manage) and he persuaded me to come in with him and after reading so much about it I went but I was treated disgracefully after I asked them to look at me so that I could lip read them alongside other things, he failed and he asked me for help with his appeal which I refused until he showed me the fairytale report he recieved in the appeal pack.

    My husband gets forms every 6 months and he's in the support group, he has just done one (well I did because he'd just had a stroke) but because he can breath he might get another medical appointment.

    What i cannot understand about the atos questionnaires and medicals are that they have the same questions on regardless of the disability or illness. My daughter is 21 and is diabetic and numerous other illnesses but this was not the reason for her being unable to work, 18 months ago she suffered major bleeds in both eyes and has had numerous operations to stabilise the sight she has left (she is currently waiting for a further op as she has had another major bleed in her left eye and this one is 70/30 that this will leave her totally blind in that eye). Her vision is extremely impaired to the fact that she cannot go out alone as she cannot see cars approaching etc. Until she has had this next op thay will then decide whether she will be registered blind or partially sighted as her right eye is slightly better than her left, but the only questions they asked where whether she could see a bus ? and how many fingers the person doing the assesment was holding up. Because she has no pain walking up steps and she can walk any distance she was asked what exactly she was doing there. Now i know there are people who are a lot worse, people in pain, people with terminal illnesses, people in wheelchairs etc but every person should be treated as an individual and there should be a section on which they type up saying exactly how illness/disability affects your every day life and then a qualified doctor looks at this and decides. Every person is different and their illnesses affect each other differently. I did not leave until she had typed up that my daughter could not draw up her own insulin as she cannot see the numbers, she cannot cook for herself as she cannot see the dials on the cooker and all the other ways it effects her, this information was on her report and she was passed unfit for work to be assesed again after the next op. Hopefully when she has had next op and been properly registered than she can get some help to return back to work as she wants to do that, but unfortunately there are people who are not in the same position and are unfairly being put in the category back to work.

    well i got my medical report form in the post the other day..

    interesting read, the healthcare professional asked my questions and then filled in what she wanted..



    spelling and grammer is not her good points, it is noted i have MS, that the condition started many years ago (yes over 10)
    it has been getting worse over the last 2 days... (what!!! i said 2 years, hense why i had to quit work)

    Apearance

    Tired: looks tired
    Build: overweight

    right so you can judge what weight i am as i am sat in a wheelchair, with room on both sides of my butt cheeks, not asking my weight/height oh dear.

    overall, i shouldn't complain as i will be fit for work in 6 months aparently.

    i do feel that although the woman was nice etc, she has ignored a lot of what i said and contradited herself a few times in this report, one minite i can do something then i can't

    i had no problems with the doorways or furniture, yes that's because i was being pushed in a wheelchair....

    good luck sunny one ..i also have a appeal on tuesday ! as atos report said i should be better by now ! but under that bit,they had written about the terrible balance,very wobberly walking ect ect...no one one read that bit ! (+ surgeon report )even thro the last appeal own medical there .said i would have it for life, and they would award for 2 years only as will proberly get worse ! all stress and madness
    the truth is out there ... on these pages !!

    It would seem that you do not live in the real world. Time and time again it is always the minority that spoil it for the majority.
    There is no other way to weed out these parasites than to assess everyone! This is exactly what they are doing with ESA now and will do with PIP (DLA) when it comes into play.

    How does the ATOS assessment encourage fraud? How does it encourage people to steal from the state?

    And how is ATOS pursuing fraud?

    Lets see?

    Do they perform real medicals to prove someone is faking, ie use proper medical equipment/scans/tests/diagnostic procedures?

    NO, they ask things like what you watch on tv etc, no real medical tests are done at all, no diagnostic work, no actual medical science is involved, its all general chat and basic movement requests.

    Do they always, heck lets make it easy, do they usually, check your medical records/notes to see if you are telling the truth?

    NO - in 87 percent of IB cases, they did not request ANY medical notes or contact the patients GP or consultant/specialist.

    Are they using people specialised in whatever condition the claimaint has, ie do they have phsyciatrists to properly tell if someone is faking a mental health condition, or spinal experts to check bad backs?

    NO - you are likely to be assessed by a generic nurse, or a retired GP with no specialist experience in your condition at all.

    Are they spending considerable time discussing the problems and tailoring each assessment in order to try to route out fraudsters?

    NO - everyone gets a standard medical that is controlled by computer, and its very generic and ignores most of the evidence provided.

    Do the assessors follow all the GMC and NMWC good practice guidelines, in order to ensure they are acting ethicially?

    NO - they most certainly do not.

    Do real medical reports from specialists/hospitals/consultants/gp's etc which may show they claimaint is not as bad as they claim (or shows they are worse than the atos report, which is non medical, and has no medical basis / facts behind it) take precendence over the atos report?

    NO - the atos report is what the decision makers rubber stamp, ignoring usually any specialist provable evidence that cannot be faked.


    To take your point about it being fine to mistreat the majority for the actions of the minority, our house was robbed before, therefore, a minority of robbers are spoiling things for others, by your logic I should be able to make your life hell and demand to have your house inspected on a regular basis just in case you have any stolen goods in it. In fact, everyone should have their homes checked for stolen goods every few months, as crime is crime, and you cant ignore it, you must pursue it.
