Fuming about atos medical

I have just got back from my esa medical.

I was made to do things that caused me sever pain, despite telling the lady that i would be if great pain if i attempted to do this she told me i had to do it other wise she would have to say that i refused and that the decison makers class refusing to take part in the activity as "able to work" she actualy said and i quote " its like the drink driving test if you dont do the test your automacitly classed as failing it."

I was under the impression if something caused you alot of pain you did not have to do it? quite frankly im distgusted at what i have just experienced it got to the point where i HAD TO REFUSE the last 2 tests as i was in agony!

i have just lost all faith in the current world we live in, i simply could not do the activitys she wanted me to it was to painfull yet now im going to be classed as able to do something because i cant actualy do it. it just makes no sense what so ever

She asked if i had any problems walking to which i said yes it causes me alot of pain in my hip, she said well you got up from your seat in the wating area and into here by your self so it appears you are able to walk unaided. i said i can walk but not without alot of pain, she said but you can walk thats the main thing.

She asked if i had any problems getting dresed or washing etc, i said all theese activites cause me pain, she said who dressed you and washed you today then? i said my self but not without alot of pain, she said but you can dress and wash your self unaided though?

bascialy she made out like there was nothing wrong with me what so ever and seems to have disregarded any pain i was in. the only thing that matterd to her was that i could do it, if i was in agony doing it that didnt matter

im so angry im just wating to see what her report actualy says now

From what you say it seems like you attended the interrogation, as I like to call them, alone or went into the room alone. First thing to do is phone the office that deals with your claim and request a copy of your report you could also ask for a copy of the score sheet the HCP & decision maker have filled in. You will be told they haven't received it yet, I was told this on 2 separate occasions for the same report so I sent in a subject access request for all the information they held on me a copy of this form can be printed off from
    http://search2.openobjects.com/kbroker/dwp/dwp/search/search.lsim?qt=+subject+access+request&sr=0&nh=10&cs=iso-8859-1&sc=dwp&sm=0&sf=&ha=1092&mt=1
It is the top link, I was able to fill mine in using Microsoft office then print it off to sign it.
I am surprised you were not told the pain was all in your mind as I was.
My personal thoughts on what ATOS call tests are that they are anything but tests and the majority of what they put in the report is taken from the form you sent to them and they hope that you will say something different from what is on the form so they can award less points.
When I was asked to get on the examination table after the HCP finally managed to wake me I just looked at her like one of the 7 dwarfs, Dopey, :rotfl:

ALthough the forms you fill in, last time I had to they did, mention severe discomfort it seems that when are interrogated by ATOS it doesn't count how bad the pain is you could be screaming like a baby and they would give the same answer
    BUT YOU STILL DRESS YOURSELF
If you have a complaint about the person who examined you the report should tell you if you where examined by a Dr or other health care professional if a Dr you can get their details from or if you can remember their name check http://www.gmc-uk.org/doctors/register/LRMP.asp

or here if not a Dr http://www.hpc-uk.org/

Thanks for the link to request all the information they hold on you i will fill that out asap.

i can not belive how i was treated and spoken to today  as she was going through each question, she must have got to the getting in and out of bed part and kind of said quietly to her self in a day dream like state "you dont need help getting in and out of bed do you" as if she was just going to skip that and move onto the next section! i was like wait a miniet yes i do have problems getting in and out of bed. she said "Why? in a patronising surprised voice

i didnt know what to think, i was in shock i was just like omg they really are doing what ever they can to stop people claiming these benifits they have no regard what so ever for us, it felt like i was being framed for crime i did not comit and there was nothing i could do.

This is beyond a joke now this is serious this is happening to so manny people and its simply not on, i am disgusted i cant belive its allowed to happen ireally cant.

all i know is i told her all the things that caused me sever pain,if the report comes back saying i can do everything and no mention of the pain i will flip my lid seriosuly

This is what really worries me. I noticed a lot of questions have been altered. They used to acknowledge pain and discomfort. But now it's as though you can either do something or you can't - no middle ground. Surely if you can do something but it causes a great deal of discomfort then it should be taken into consideration. If you then do a job that causes a great deal of pain and you leave, you'll be classed as making yourself unemployed. But if you struggle on then you're going to end up in a worse state of health and possibly a risk to yourself or others.

Iain Duncan Smith claims that those in need, need not worry. this is total garbage. some of the questions make it look as though you are perfectly fine, but this is only because there isn't an answer that you can honestly tick regarding your state of health. Hands for example. It seems you can answer that you definately can do something or you can't. what about being able to write but it causes you pain and then results in you having stabbling pains on top of the pain you started off with. Yet you could not in all good consciense say that you couldn't write, but there doesn't seem to be anything that states doing a task takes ages and causes more pain.

iain Duncan Smith and the rest have absolutely no compassion for genuinely ill people. it seems that if you're on life support then they'll accept you can't do anything, otherwise we're all jiggered. I can't tell you how all this worry has added to my problems, but then I'm sure a lot of you don't need me to tell you because you're probably all worrying as much as me

  • Do you think we should all get together on a 'class action' and sue the flaming Government for untold stress, worry and anxiety. Doesn't stress increase the chances of heart attacks? That would put even more strain on the nhs!

If we put anybody (politicians) under undue stress we'd be charged with all kinds of offences!
  • Hi that sounds like a nightmare, they shouldn't make people do things that causes great discomfort.
I had my medical on the 25th of January the lady that did mine was rushing through mine. I got taken ill in mine three quarters of the way through I told the lady I was ill and she could see that I was ill but she continued to examine me with my son dabbing my face with a wet cloth.

She did my blood pressure and she asked me several times had I take my bp medication that morning which of course I had.
She kept saying it won't be long I am nearly finished. I was really ill she wasn't a bit concerned, my son had to practically carry me to the car.
I am lucky I have a great ds who helps me loads, he was disgusted that she carried on with the medical.

My son took me to the doctors, my blood pressure was high my doctor said that they should of stopped the medical, and that I should put a complaint in I haven't got the energy for that.

I don't know how long it will before I hear anything I will just have to wait and see.
I wish I could work and wish I don't have to rely on benefits.
    Sorry to ramble
Try not to worry I know it is easier said than done.
    Hugs to you.
    take care

    OP that is truely shocking.

I had my ESA medical Wednesday of last week, and although i was in my wheelchair, i offered if she wanted me in a normal chair, she said no.

When i came to physical stuff, she asked me was i capable of getting out of my chair, i said depends each days is different, was having a bit of a rubbish day, but she wanted to see, and i needed the help of the person who came with me, she asked me to do various things, which i did attempt but she could see it was causing pain, and asked if i did such and such would it hurt I said yes so she told me not to do anything if it hurt, or caused more pain.

From what i have read on these forums and others i half expected hitler to interview me, but infact i had a nice young lady, english wasn't her first language and she was very softly spoken so i stuggled to hear her, but i couldn't of helpped that.
