    Can I have your opinions please, all will be most welcome..

    My Capital One limit is £200. They slapped a late payment charge onto my account, as I was a week late in making a payment, and this charge took me over my limit, which then has snowballed my balance each month, as I couldn't keep up with all the charges they kept putting on, until my balance hit £430.

    I wrote to Capital One (sent by Special Delivery) and I have checked with Royal Mail, who confirms it was delivered on 19/01/07.

    I used the initial letter template from this website, requesting that they refund all charges, and provide me a copy of all my statements so that I can check they have offered me a full refund. I ended the letter stating that I expected a full response in 14 days.

    The day after sending this letter, I got a standard letter from them advising they were registering an account default onto my credit file. These letters obviously crossed in the post.

    To date, I have not had the courtesy of a reply, or even an acknowledgement, however, I have been telephoned at work (twice) by a company called Frederickson International, who said they are debt collectors acting on behalf of Capital One.

    I advised them that I had registered a dispute with Capital One, and they simply replied that as I had done so after the date they had been instructed by them, I was basically wasting my time!

    I know that the 14 days is not up until Friday 2nd February 2007. What would you suggest I do on that date, if I haven’t heard anything from Capital One? Should I pursue this, or am I wasting my time like the DCA said?

  • Thanks to the many people with their assistance.

    After the 48th day I decided to call LLoyds with regards to wheres my paperwork and all that stuff.

    This allowed the Xmas and new year to be added due to their staff being allowed a day off. LOL


    SURPRISE... after the phone call, 2 days I had a delivery from a courier and 3 boxes of A4.... grrrrrrrrrrrrrrrrrrrrr :rotfl:


    Now I know why the rain forests are being cut down...



    I have looked through my statements and I see that I only have £650.50 in charges but £4875 in interest charges... :mad:


    Talk about getting you both ends....


    Can someone ask the legal profession to change the law so that interest can be claimed please...... :rotfl:

  • I was wondering if the same principle of bank charges also relates to credit card charges. Recently I credited my credit card account, but the payment (the minimum required was £5) was received a few days later than the deadline. For this I received a late payment charge of £12.50. This is in addition to the extra interest added on to my balance. I was told by the Cards representative that this charge is a penalty for doing something wrong. I was also informed that the charge amount had been reduced recently from £20.00.

    Yes, just amend the letter to reflect your credit card account and the relevant late charge.

    The level of £12.00 it is now set at, does not mean this charge is fair in consumer law. If they actually used the word 'penalty' in referring to this charge, then this shows the employees haven't been educated on the regulations about this. Penalty charges are not allowed, the fee must only be the actual costs incurred.

    You can still claim for the whole amount of the charge unless the credit card company are willing to provide a breakdown of their costs in relation to this charge.
  • if british gas only charge a £5 fee to administer a late account then surely this is a fair rate that credit cards and banks should charge not the £30 20 15 they now charge. maybe this is what the financial services need to rule to the banks/credit cards
  • Hi people,

    I have followed martins advice to the letter (apart from when i cut and pasted details into money calim online and it was too long for their forms, i had to cut bits out!) and have now taken Yorkshire (clydesdale) bank to court.

    They left it to the last day to enter a defence (I got it this morning) and now have to complete my court allocation form.

    I the part "G" any other information did people just leave blank?

    I part "F" it asks if i have paid a fee, i paid money claim online, but didn't think i had to pay for this form as my claim is under £1500 (£1350) it states the case can be struck out if i do not include a fee!

    Has anyone been through this process, would you advise a solicitor?

    Any help would be appreciated, thank you.

    i have just been on the phone to lloyds credit card asking for past statements but they are saying i will have to pay £164 for them what do i do?
  • You don't ask for statement but follow Martin's article and send off for your information using the first template letter and enclose £10. Banks are entitled to charge for copy statements and they do.
