Can I ask a question?
I know it says for England we can ask for 6 years worth of charges to be repaid but does this mean 6 years to the date of claiming, from the tax year of April or from the beginning of 2000?
I am looking to claim back from Barclays charges starting on the 21st Jan 2000 upto 26th June 2003. Total charges for that period are £335.00, plus interest of £158.18 which totals £493.18. I sent the letter to Barclays in November and they sent a letter today offering a goodwill gesture of £150.00. If the charges I can claim for are only from Nov 2000 until now then that would only total £140.00 plus interest, in this case I would be better to accept their offer or can I claim from the beginning of 2000.

I have had an offered a payoff before taking action which I am going to decline but before getting a chance to send another letter threatening court action the bank has paid the money into my account - does anybody know what to do next?? Would be grateful for any comments - thanks!!0 -

Write to the bank saying..............
I'm afraid I cannot accept £XXXX as a full and final settlement of my claim. I will accept this as a part payment and without prejudice, but I will continue my claim for the balance.
If possible, do not touch the money the bank has put into your account until your claim has been settled in full.How many surrealists does it take to change a lightbulb?

This morning we have received notification that Barclays are defending my daughter's claim and the proceedings have been transferred to our local county court. She will have to pay a further £100. Has anyone ever got this far and actually had to go to court? We are shaking!!
She inadvertantly hadn't stated her bank account in the court claim form and they mention this in their defence and she also stated that what the bank was doing "was part of a profitable scheme that unduly enriches the defendant", which of course they are defending.
Do you think they'll actually go to court, and do you think we should tick the box asking for a 1 month postponement so that 'a settlement can be reached by informal discussion' ? Please someone put our minds at rest.......0 -

I am new to this site and finding it really interesting. I have already claimed £750 from the HSBC very quickly and successfully but now i am slightly scared and could use some advise please.
I am wondering if anyone has had a positive experience with the Abbey as I have sent all the relevant letters and the last one i got said "fine, take us to court". I haven't yet as i am concerned as to what the risk to me may be if i lose.
The claim is for £1700 so no small amount. I don't want to wimp out after all this and let them get away with it but neither do i want to end up with the possibility of losing and in more debt than i am already in. Also will i have to appear in court personally as i am not very confident with that sort of thing. I wouldn't know what to say. Any help/advice will be greatly appreciated.

first time using/asking questions on internet chat forums hope i am doing it right.
my debts to banks/credit cards which include rolled up interest charges are now in the hands of debt collection agencies. can I still claim against the banks?then I could use the money to pay back some of what is owed to them

Hi there, just found out that Natwest (or is it royal bank scotland, who knows) are taking £240 in charges off me for one month. So i got confused when my direct debs were coming out and spent too much on xmas but hey i don't desreve this. Ive been charged for going over limit for DD's paid for DD's not paid and anything else they feel like doing me for. My bank manager agrees it's outragous but says only head office can do anything, he also encouraged me to follow Martin's tips for reclaiming, waiting for 6yrs of bank statements to arrive.0

I have followed the guides given on the web site and have now received a repy from the courts telling me that the bank is defending the claim. I really am worried any help would be appreciated. First time to use internet for help as well. Mary Kitt0

Hi There
I have sent my 2 letters and LBA to HSBC for £3365. Started court proceedings 21.12.2006, HSBC defended claim via DG solicitors 24.12.2006.
I have had an offer for £2000, which I have formally declined.
I am due to go into hospital 17.01.2007 for an op and will be in for approx 5 days. Do I need to let the court or DG know I will be unavailable during this time?
I was hoping HSBC would have got back to me by now with a reasonable offer!!
Hope someone can shed some light.
