    I hope this is the right place. Im a single mum of three children on income support. Ive had a HSBC bank acoount for years and a joint named mortgage also with them. I really feel im losing control of a number of debts mainly because of bank charges continually being added. Im hoping to get back into work soon but im really struggling as im constantly trying to juggle enough to live on. My question basically is how can i get another bank account to start your system of recovering charges , when my only income is benefits, i now seem to be always over my overdraft limit because of charges . Is another bank going to take me on? Will this also effect my mortgage.. if i can move banks and or try to recover charges.

    i heard all about this topic previously but didnt think it was as easy as it actually is i was worried about not winning the case but after reading all this im going ahead with getting all the charges back from my bank
    in all it amounts up to about 6000 over the last 5 years, and thats money i cant miss out on .
    many times my bank left me with barely a penny in my account from unpaid direct debits and going overdrawn ( by 30 pence in many situations)
    which left me to struggle to even get the weekly shopping.
    at one point i had a temporary over draft because they had taken 3 charges out in one day then charged me for that.
    im absolutely disgusted in the way banks are allowed to charge hard working people these kind of charges, how can they justify it?
    im so glad you brought this topic to light ive gone to the bank and paid the fee for all my bank account statements for the last 5 years and will soon get the ball rolling

  • Hi. I'm with First Direct - have been for 20 years but am thinking of changing now...
    I am possibly being rather stupid - BUT - is an overdraft arrangement fee a penalty charge that I should be claiming back? Cos I've got lots of them!

  • Hi folks, Firstly can I say what an excellent site this is, absolutely superb!

    Up until 2 years ago I had a current account with the Clydesdale bank, I found myself in significant debt because of their bank charges, most of my monthly wage was kept by them!
    Although my account with them ended 2 years ago I still feel very angry about the money they took from me, not to mention the stress and anxiety they caused me at the time.
    Would I be eligible to claim against them from the year 00 to 04?

  • Welcome to MSE, and yes you can claim on a closed account although in Scotland it is for the past 5 years unlike 6 years in England and Wales :)

  • Hi all, well this is a palarva, had an ORDER from the couurts wanting to know why i think these charges are unfair and unjust, and wanting to know loads of othere stuff, Seem to think Barclays are going to use me as an example to otheres, after they have put up a good defence, reads like the book "war and Peace" took ages to read, and me being a layman, didnt even understand half the words in it, well here goes got nothing else to lose, just hope gods on my side now...o0h and the judge... will have to see what happens..

    Claims can go back 6 years. (And some people are challenging even THAT limit). Get all your statements and go get 'em ;)
    Any advice I give is based purely on personal experience. I am NOT a professional or expert in any field except insect genetics!! So be warned!

    Do they tell you what Barclay's defence is? I think you should speak to a MOD and let them know exactly what you've been sent. Unless Barclay's can prove their costs amount to anything like their charges I can't see how they can have a "good" defence. Do you have a court date or have you just received the allocation questionnare?

  • Over the months i have taken your advise aand such, done whats suppoesed to be done.... and Barclays have put up a defence, so i paid the £100 allocation fee, so the case was from Northampton to Wakefield county court NOW they are reffering it to Leeds County court.... is that a good thing or a bad thing?

    I shall be sending the second stage letter if I don't hear from Lloyds by Thursday. As I haven't heard a dicky bird since sending the letter I am not expecting to hear before this date.

    In the letter you have to state which court you are going through. Do I put the nearest small claims court to me? I want to make sure I am doing the correct thing as it is getting nearer to Christmas and I don't want to muck this up! I could go to it but read you advise to do this online so you can follow proceedings better.

    Fingers crossed I don't muck it up! :rolleyes: :p
