  • Right I'm really confused now...

I havent recieved a text message from T mobile yet advising of the changes, and checking my (paper) contract, there is no mention of what price plan I'm on. I know for a fact im on the 25 pound a month with free internet, so I assumed that I would be ok, but obviously not.

I was told at the time of renewing my contract that the phone the were giving me (the Sony Ericcson Vivaz) was an andoid phone, but looking into it, its not! They have my phone at the moment as its constantly faulty (over the last 2 months i think i have had it for a grand total of 2 weeks) So im reluctant to play merry hell with them until I get it back, but thinking about it, have they not missold me the thing in the first place?

I stated to the sales person I wanted an android phone at the time, as i was accutley aware they were the better phones. and what they hav provided is not the case! i am really unhappy at this as I trusted the salesperson and what they were telling me, and they told me a bald faced lie!!!

Should I contact them or wait until they contact me???

    Thansks

you really are sad and pathetic

Jamespir, I appreciate an alternative viewpoint as much as anyone, but just randomly stating things as fact isn't particularly helpful to the debate. Especially when you aren't backing any of it up with sources and you've made some fairly unlikely claims. Now you seem to just be name calling, which is also unhelpful.

Can you either provide some sources for your claims or maybe make another thread for them? i don't think they're particularly appreciated in here.

    Thanks.

Just another of your incorrect assumptions based on no supporting evidence.

Tmobs terms say they can give US notice via email, so this.means they accept it as a form of notification themselves by default.

well dont blame me when your being chased a year down the line for a bill for a phone you thought was cancelled

You really have a couple of separate issues.

One is the issue of potential change to T&C which may be to your detriment and can you cacnel (which is what this thread is really about)
Secondly how would you go about proving that you were mis-sold a phone? I am not saying it cannot be done but might be tricky, particulalry given the length of time you have had it. (even if you haven't actually had it working in that time)

their legal team obviously know what they are doing

    You'd hope so wouldn't you?

However, T-Mobile wouldn't be the first big company to have terms and conditions in their contracts that are unenforceable or invalid.

What makes it worse though, is it's not unknown for a company to tell the customer their terms override any other regulatory procedures and in some cases even consumer law. Unfortunately, many people don't know better and just accept what they're being told.

Their contract and their word is not law.
