There must be some fun going on in T mobile HQ at the moment.
It does, so their only argument would be that the change is not of 'material detriment'.
I find it hard to believe their legal team did not consider Ofcom 9.3, but for some reason they appear to be trying to press home their own T&C's over Ofcom regulations. My guess is this stems from poor communication channels within the company.0 -
Just because they've said it doesn't make it true. Look at all the other untrue things they've been quoted on in this thread.

I got out of a three 24 month contract 2 months in, as they changed the T&C's on their 'three abroad' plan. I got to keep my shiny new Nokia E71. They didn't even mention maybe returning it.

I called again and he said that he will release me from it but he has to check the IT dept. I expect it to be a load of tosh but don't know what to believe. Either way i want out as thisa is just getting out of control now.0 -

Having dealt with the legal department at T-Mobile over this, I can tell you that they are simply clueless people trying to be too clever. The reason the T-Mobile contract has so many holes is that they are trying to avoid Ofcom 9.3, but cannot do so in any sensible way, as this would fall foul of Ofcom.
An MBA at T-mobile has run a spreadsheet, and has worked out that screwing customers is more profitable than obeying 9.3. The only danger is Ofcom being forced into action or a court settlement. Hence T-Mobile try to bluff or settle out of court/summary ruling. However, this may turn into a regulatory, PR and legal disaster, if enough of us cancel and complain.0 -
