    Oh dear seems to be getting worse.

    what they are saying is if you go over say once or twice there will be no charge but if you go over constantly or by a huge amount then they will warn you then charge you

    I'm trying to give you the benefit of the doubt, but now you've got it wrong twice.

    Firstly, your phone is not part of the contract. I bought my phone from a third party. They went and bought the phones sim-free (because T-Mobile couldn't supply them). They have an additional contract with me that says that if for any reason I cancel the contract within 120 days, because they don't get the commission which covers the cost of the phone, I have to pay them £240 for the phone.

    So T-Mobile didn't provide me with a phone, the third party did. I've spoken to the Third party. They've been paid by T-Mobile so they don't care if I cancel. In fact, they've offered me a new contract with a new phone :D

    Secondly, if you believe that Mobile Phone providers always get it right (especially on this count) then you need to look at the thousands and thousands of people on MSE (and other places) who have had their phone contracts CANCELLED because of unfair clauses and changes to the contract. The lawyers almost always get it wrong. There's only 1 lawyer for and hundreds against.

    So T-Mobile probably have got it wrong.

    T-Mobile by the way aren't exempt, they had the same problem just over a year ago and lots of people got out of it

    Tmobs terms say they can give US notice via email, so this.means they accept it as a form of notification themselves by default.
