Just got through to what sounded like a gruff scotsman. Kept talking over me and repeatedly stating they had not broken any terms, even refusing to let me quote the terms they have broken to him! I am now expecting a call back from a manager "within two hours".

they havent in a way the only thing that could come in to question is the thirty day notice period but theyve offered some kind of compensation for that i believe

  • When making statements can people please provide links to the source to back them up.

Otherwise you might as well say anything and claim it to be true.

That equates to breaking a contract.

Once broken you need accept no compensation.

So does that mean they are now honouring cancellations now?

I know it's really frustrating talking to the CS at T-Mobile, but remember they are forced to toe the company line. They've probably been given minimal information and just told to keep reciting that you cannot cancel without charge. Without being disrespectful, they are effectively drones and their discretion is severely limited.

Getting to speak to someone who actually has the power to waive the charge is the key. I suspect this will not happen though!

That letter is mine. T-Mobile will deny your statutory rights unless OFCOM force them to do otherwise. However, you do not need T-Mobile's permission to cancel and they must give you a PAC. Send the letter by recorded post. Don't bother to talk to them, it is a waste of time. Don't email, send the letter to the legal department by recorded delivery.

Here's the cheque I got last time:

You just need to be brave. In my experience the legal team at T-Mobile is clueless.

  • If you haven't haven't been informed about the change, you can cancel. If you have had the text you can't as put to me by a T-Mobile manager.

I've heard it's likely tmobile has only sent texts to customers who are more likely to be affected, however if that is true, surely it implies the FUP reduction will be of significant "material detriment"?

Still, under ofcom 9.3(b) "inform the Consumer of the ability to terminate the contract without penalty if the proposed modification is not acceptable to the Consumer" since the changes are unacceptable to me, I should be able to terminate without penalty.

Seems remarkably clear cut doesn't it.

There must be some fun going on in T mobile HQ at the moment.
