    People, please just call them up and cite the following:

    OFCOM's general terms and conditions 9.3 which states:

    9.3 Where the Communications Provider intends to modify a condition in a contract with a Consumer which is likely to be of material detriment to the Consumer, the Communications Provider shall:
    (a) provide the Consumer with at least one month?s notice of its intention detailing the proposed modification; and
    (b) inform the Consumer of the ability to terminate the contract without penalty if the proposed modification is not acceptable to the Consumer.

    T-Mobile have no where to go but release you from your contract.

    It is also against OFCOM regs not to give you your PAC code and they have to supply it within 2 days of you asking.

    Edit for jumping the gun on new regs.

    This is correct, and will be being shortened to 'within 2 hours by SMS or immediately, over the phone' at some point this year.

    Still waiting for call back 3 hours after the cancellation guy told me he would call back in 10-15 minutes! Dialed 150 and didn't even get connected... Let's try again!

    I've been watching this thread with interest as I really need to upgrade my phone. It has been due for a while but I've noticed that my current one isn't goint to last much longer. I was going to call up for the HTC Desire, staying with t-mobile because of the 3GB limit. I've just checked the website and it still states Android phones get a 3GB FUP.

    So ... should I upgrade while the contract still shows 3GB FUP or should I wait until Feb to see how this all pans out?

    I know it's really frustrating talking to the CS at T-Mobile, but remember they are forced to toe the company line. They've probably been given minimal information and just told to keep reciting that you cannot cancel without charge. Without being disrespectful, they are effectively drones and their discretion is severely limited.

    Getting to speak to someone who actually has the power to waive the charge is the key. I suspect this will not happen though!

    Your provider cannot refuse to issue a PAC if you have any outstanding bills or charges to pay.

    Definitely would advise you to wait and see how this pans out.

    Info from T-Mobile reps suggests that this will apply to all internet users with them, including Android phones such as the HTC. The info on the website, if they've been saying this, is out of date. Wish I'd known, I've only recently started my contract with them on an HTC Desire. 500mb's never going to be enough. :(

    Really angers me that they've still not removed the 3gb advertising on their website. It's misleading, disgusting behaviour.
  • What people on this forum are ignoring is all the advice that states don't just order a PAC.

    If you order a PAC witrhout going down the correct route YOU WILL BE CHARGED TO DISCONNECT FROM THE NETWORK.

    But of course continue to argue with the poor staff at customer service who are only doing their jobs. Ignore the correct way to follow this out that all the kind people have informed you of to help you out. That won't mark your credit file doing it the incorrect way.
