I got my cashback in full paid into my bank today :)

To help others in a similar situation, here is a copy of my LBA.

WARNING: NOTICE OF IMPENDING LEGAL ACTION – DO NOT IGNORE

    DATE

    Dear Sir/Madam,

    Mobile No. _________
    Cashback No. __________

I refer to the above overdue cashback and note that it has remained outstanding after such a long period. Despite previous emails and an online chat, no indications have been given as to when payment will be made.

According to your Cash Back & Reduced Line Rental Terms & Conditions all cash back payments will be paid within 60 days of the valid claim date. You received my valid cashback claims on all the required occasions, this is now over a year overdue.

I now regret to have to formally write to you and inform you that should I not receive the full value of this outstanding debt in my bank account within the next 7 days, legal proceedings will be instigated against you without further notice to you. This will result in you having to pay statutory interest on the debt from the above due date, additional legal costs with debt collectors sent to your company to seize the assets to cover all outstanding amounts once judgement has been obtained.

I suggest that you obtain legal advice in this matter or settle this outstanding debt immediately and I look forward to hearing from you within the next 7 days.

    Yours faithfully,

    ________

I just wanted to confirm something. My wifes payments have all been made except for the final cashback where the 60 days expires on 02/06/08. I didn't need to send a letter and legal action threats over the chat worked for the 5 payments. However, because they have fundamentally breached the contract, can I claim my final payment too before the 60 days is up?

No I dont believe so as it is a redemption scheme and you have a payment date and if that payment date has not been reached - dont think you will get it and be able to take court action till the date has passed - could be wrong but dont think so
    Back and on a mission:cool:

Well i have got 2 outstanding claims at the min and have been on the online chat a few times but got told there is a back log. So when i got told the same again on Tuesday i threatened with MCOL to be told suddenly i would receive my money within 14 days! Lets see if the money arrives.

Just goes to show though that they are willing to fob people off as long as they can but as soon as they get threatened by claims they pay up.

Just received my cashback for 2 contracts using the online chat method. A couple more claims to go and then I will have received everything for 5 contracts. Hopefully they won't go bust before then!

I was also told that I would receive my money within 14 days - I'm wondering if you've received yours?
