    Did you do the LBA for the full amount owed?

    If so, paying the late claim doesn't mean they can reinstate the contract, and expect you to go through all this each time you claim.

    Accepting the money they are sending you doesn't stop you pursuing your claim for the full amount.

    oh great my first cashback was due about a week ago but not been paid. i had gone on live chat a week before the 60 days was up and told i would be paid on 10/04/08. the date came and went to went on live chat again. guess what i was told? there is a backlog - dont know when payment will be.

    looks like LBA then MCOL might be the route to take. How long should i leave it though before taking this action?

    Before sending LBA letter, try threatening them first via online chat stating that you will sue if they don't pay. It has worked for me and others in the past.

    If you want to use their fundamental breach to get paid the whole amount outstanding, then you need to put this in writing.

    Well worth the trouble (and the cost of a stamp) to get all your money and not have to go through all the hassle each time a claim is due.

    does it matter that i only have one payment outstanding so far? should i hassle them for it now or wait till my other cashbacks are due?

    If they have not paid you despite you claiming correctly, then they have committed a fundamental breach of the contract.

    I have not received ANY cashback that I am owed from 2006-2007
    They owe me £180
    I used their online tracking thing and I got an email back asking if I want vouchers.....
    Then I tried the online chat and they just did the same thing.

    I am now going to get my solictor to write them a letter.

    DO NO buy anything from this dodgy company

    I would imagine you don't know how to solve it, which is the reason it has taken so long for you to "nail it".
    Forget about solicitors, send a LBA (Letter Before Action) telling them they have 10 days for them to issue the cheque for all outstanding payments or you will sue via Moneyclaim Online for the full amount plus all costs involved plus the interest. This normally works and you should be sorted ok as long as you have done everything right. As long as you don't chase things up they will see this as an opportunity not to pay you. Once they know you have the knowledge to sort this mess out they should pay up and avoid future costs. I wish you had come here sooner and you would probably had it sorted by now.
