  • If it's any help to anyone - I got my first two payments shortly after threatening legal action once they were about four months late. At the end of June soon after sending the sixth (and last) claim in, I used the online chat facility to ask when I'd be getting the remaining four cashback payments. After turning down the usual gift card option, they then offered Marks and Spencer or Asda giftcards. I figured that as you can use an Asda card to buy food, it was worth getting rather than waiting for cash, and the card arrived about a week later. Happy ending.

    Hubby received his 4th cheque yesterday and has only 2 to go. Ironically they same to pay better than ever now, as they used to. I though he (hubby) was mad to use Mobileshop again but all has worked out ok. 12 months free and a Nokia 6300 (sold on ebay) and of course Quidco, so a great deal. He never got offered an Asda giftcard, but stated in their poll he would accept a supermarket, or petrol giftcard. Maybe worth looking into, thanks.

  • A question for Quentin I think -
    Briefly - 2 claims already paid, 4 claims were outstanding, 2 then overdue.
    I sent an LBA threatening Moneyclaim unless all 4 outstanding were paid as contract breached, they paid the 2 overdue only!
    The 5th is now just overdue (6th and final due next month).
    They obviously ignored LBA threat - do I now issue Moneyclaim?

    When you issue a LBA and the debtor only pays you a part of the sum you requested in the LBA, then you can proceed with the action threatened in the LBA for the balance still owing. (Always assuming you are confident you will win!)

    Thank you very much for the response, I hope that my first posting did not seem 'curt', I was trying to avoid a lengthy diatribe.

    Are you aware of Mobileshop behaving like this before? - I got the impression from the other correspondence that once challenged they complied.

    Are you aware of anyone else actually going through with a Moneyclaim and the outcome?

    Why are they being allowed to continue trading? Has nobody reported them to Trading Standards?

    I do know of someone issuing a MCOL, but they paid up (in full) on receipt of the summons, and no-one has posted that they needed to have a court hearing to get paid.

    There are, though, many posts indicating that the threat of legal action gets them to pay up.

    Just being late paying their bills isn't grounds for stopping them trading!

    In my case the threat of legal action only produced the 2 casbacks overdue at that moment, the other 2, 1 of which is now overdue, were ignored.
    I am now faced with the choice of forgeting the previous LBA which covered the now overdue claim and threatening yet again (and then again presumably) or proceeding to MCOL - do you have any observation?

    With regard to stopping them trading, in a situation like this where it is obvious that it is their deliberate policy to avoid complying with their obligations under each & every contract rather than just paying the occasional bill late then they definitely should be stopped from trading and it is something which I certainly intend investigating.

    Knowing from the previously posted reactions from them to getting a threat of legal action, you might want to try another LBA - which is less hassle and time consuming than a MCOL - which you have to pay up front for, then reclaim from them if/when you win (or they settle out of court). (Though by just paying you the overdue money, they may have been "calling your bluff" over the threat to sue them for the (then) not due final 2 payments).

    Regarding their trading position, it looks like they no longer trade as a retailer, but provide affiliated links to other retailers.

    As Quentin stated the seem reliant on affiliate links, but I have always imagined they have a decent business customer base as well - could be wrong though.
