Hi
I've been reading this thread for many weeks but didn't register. I too am owed cash-back by S3G, £360 to be precise. I did get an acknowledgement from them saying my claim was received, was valid and that I should allow 45 days for the cheque to arrive. This was for the first installment of £90. The email was signed by Sam, who I thought was female (just a feeling).
The cheque did NOT arrive and 107 days have elapsed. While waiting though, the phone developed a fault. S3G by this time had stopped replying to my emails so I wrote snail-mail to their Bagshott address. I got a written reply from Sam, (I still have the impression she is a girl), advising that the cheque would follow within 30 days and that I should take the phone to the Car-phone Warehouse for repair.
Car-phone Warehouse did repair the phone and told me that S£G was a subsidiary company of theirs.
This, if accurate, may help us in our collective claim.
BTW, the original cheque and the next in line, have still not arrived.

Many Thanks for the message Steve and Sarah.
I think forums grapevine has picked the wrong end of the stick.
I am just a Trainee who works in a legal system of Corporate Recovery, Disputes in Joint Venture of MNC Companies, Investment Appriasal, Business Modelling etc etc.
AS I said earlier, I have always been interested in Companies like simply3G, by that I mean businesses going down and keep watching their moves to recover the major flaws in their business models actually designed to make them money.
Usually, I never get involved in discussions like this but this time just thought to share my experience which could be helpfull.
No wonders consensus is divided in two different ways of dealing the matter.
I never meant that your way of dealing is wrong but what if this guy is genuine and trying to recover his business unlike other companies (like www.phoneboxdirect.com) that went straight in to adminisatration because they hardly had any thing to loose.
If court orders and other agencies forces him to liquidate the business you are the people to be worst affected being the unsecured creditors.
I here by declare that untill now I am not related to Simply Communications UK Ltd p/c Simply3G in anyways, but might be in the near future if this company falls in our administration where I would be very interested in carying out the post mortem.
Sorry If I misleasd you people in anyways.
Thanks

I was wondering if anyone could give me the address to send my cashback claim to?
I usually get it on the website but had a bit of a surprise when I looked last week and found it very unhelpful. I had not realised people were having so much troule getting their cash.
I'm not very hopeful but think I shuold at least send off my claim. Am very interested to know how to go about making a claim through the courts as I think it is totally ridiculous that they are being allowed to rip people off!0 -
The correct cashback address is:
Line Rental Offers
Simply Communications UK Limited
Bagshot House
37-39 High Street
Bagshot
Surrey
GU19 5AF
However please see comments throughout this thread as to whether Simply 3G are actually trading.0 -
From TS this afternoon:
Thank you for your email of the 23 January regarding Simply 3G. I note
you state that the firm owes you money, but you do not say under what
circumstances. I also note that you ask if the company is still
trading.
I am not able to add much to what you probably already know as regards
whether or not the company is still trading. I can confirm that at
14.00 this afternoon, the company's website (https://www.simply3g.co.uk) was still
available to view, and that the company's record at Companies House
(https://www.companieshouse.gov.uk) suggests that the firm is still active. I
am not currently in a position to expand on Simply's trading position
other than the information supplied in the company's emails.
Your best option for recovering monies due depends greatly on whether
or not the company is still trading. If it is not trading, or if it should
go into administration at some point in the future, you would probably
have to lodge a claim with the administrator as a so called "unsecured
creditor".
Under these circumstances you would probably receive a small percentage
of the monies owed, if anything. You may, dependent on your circumstances,
be able to make a claim from any relevant credit card. This is however
unlikely if the monies owed are as a result of a so called "Cashback"
scheme.
If the company is still in business, then I would suggest that your
best move is to attempt to negotiate with them for a mutually satisfactory
resolution. I would suggest that this should be in writing, and you may
wish to direct your queries to the Bagshot address. Alternatively you
could consider taking the matter to the Courts. should you feel that you have enough evidence to win a case. If you are considering taking this
route, then you should be aware that you will have to pay any Court fees until such time as you won your case, and any judgement is met by Simply 3G.
Your enquiry suggests that you think the firm may be in financial
difficulty. If this is the case, you should be aware that the level of financial risk in taking any matter to the Courts is much greater, as the company may go into administration before the Court process is completed.
I hope that you have found this information to be useful. Should you
require further advice, Could I ask you either to provide your postal
address, so we may establish which authority covers you, or contact
Consumer Direct on 08454 04 05 06. Thank you for bringing this matter
to my attention.
Yours sincerely

I have had the same reply but I fear that this looks a little bit of a cop-out.
If, as Simply3g suggest, they are working with Trading Standards then this looks like odd advice.
On the other hand, I believe that it is a criminal offence to trade whilst insolvent and Trading Standards should enforce this or deal with the appropriate regulator.
Simply3g's refusal or inability to reply to letters and emails regarding valid claims IS a matter for Trading Standards who should be taking some action."If you can bear to hear the truth you've spoken

Sorry if my reply was a little harsh - it just seemed from the way that I read your posts that you had something to do with S3G - I therefore appologise for calling you a troll. It just seemed like you were trying to wind us up suggesting that we negotiate with the invisible people who do not answer our emails.£2008 for 2008 club member 3360 -

I also received an almost identical response from Tim Tusler.
It does really annoy me. I feel that they should be doing more to uphold our rights as consumers.
Oh well the fight continues in court£2008 for 2008 club member 3360 -

My own gut feeling is that issuing CC proceedings will be a waste of money. Good luck to the others in the thread who are going ahead with this.
I would have a bit more trust in this concern if they would reply to letters or emails. At present it looks as though they could not care less.
Trading standards really need to do more. They are quick to act with all guns blazing if a bloke sells apples by the pound!"If you can bear to hear the truth you've spoken
