Hi everyone,
When they didn't and I asked for a warrant to be executed I received a response from the bailiffs that there was no one there and they had no where else they could try to obtain monies (this was the end of last week). Yet I see some of you have had signed for mail and county court claims signed by them since then! So what's going on?
Seems to me I wasted my money trying to get anything back as the bailiffs have just give up!.. Anyone have any idea what else I can now do?

I suggest you recontact the Court and get the bailiffs to confirm the EXACT address they went to.
Also, Special Delivery mail is still being delivered to the Bagshot address - mine was only last week. You could ask the Court to to find out how hard the bailiffs are trying. You have paid a fee for the bailiffs - you are entitled to answers. Did they make enquiries with neighbouring premises etc...
Ask them to reattend?0 -

If you go back to MCOL you can look under Enforcing Judgements or similar. There is an option to ask the Court to order the directors or member of the company to attend Court for questioning.
For this however - you need their details. Hence my earlier question (not yet answered) asking if anyone knew those details.
They are available however from Companies House for £3 (I think it is £3)0 -

It's the first time that I've seen this blog, but it looks like I've joined a merry army of people trying to claim cashback from Simply 3G. Like others, I decided to invest my energy and frustration through a moneyclaim court action. After seeing off their defence and winning the case I am now poised waiting to see if a bailiff can recover the money owed through a warrant of execution. This court process has cost an extra £85 in total (£30 for initial court fees and £55 for the warrant of execution), so I'm very much crossing my fingers and hoping that the bailiff can find someone at their address /assets to seize. If this proves successful I'll post an update straight away.. But if anyone has any success getting money back this or any other way please post an entry on this blog. Until then, might be worth holding back from posting any further warrants of execution (I don't want anyone else to waste their money! After reading up on warrants of execution on the web it looks like they're a bit of a gamble). If my warrant proves unsuccessful I'll join in the hunt for these company directors... And make them wish they'd never entered business!!! I can't believe they're allowed to continue trading when they must have so many CCJs listed against them!!!0 -
If anybody has actually received a cheque from the company and can remember the bank details then try the 'Third party debt order' route(Garnishe). Check out the MCOL site for details.

Hi Weby. I am currently awaiting the next move from Simply3G - they acknowledged service on 10th Jan - so I have still got another week or so to wait to find out what was going on. Did they submit the defence straight away or did they file an acknowledgement first to stall things even longer.
I cannot believe how toothless Trading Standards are.

Thanks for the posts, now I can confirm they have lodged a defence and I now have a copy of that defence from the court. They have lodged their defence saying "Simply3G are a non trading Dormant company signed by the MD with his/her Date of birth. So firstly they are replying to court letters at the registered address. They have then sent in a copy of what is on the web on the companies house website which says they are a non trading dormant company. However this apparently means nothing it just means thats what they have told companies house. So on to the next step see you in court in my home town, doubt they will pay to travel for that. What a weak and pathetic excuse.0 -

But surely anyone wth half a brain can see that they are still trading - their website is active and they are still selling phones. It drives me potty that they are still trading and p*ssing everyone around. For those people who have instructed baliffs already - is there anything stopping someone with a CCJ turning up at the office with the Police in tow and taking items to the value yourselves? I dont know how these things work.

My court claim was registered against Simply3G Ltd. What did you do yours as, that was because thats what their e-mails confirming the cashback said. I spoke with Companies House and they say that the fact that it's registered as dormant is irrelavant, unless its all a scam how these people can sleep at night I don't know. However, they seem to be trying anything and everything with us all.
Does anyone who has had a judgement entered confirm what they put on their court paperwork.0 -

My court claim was registered against Simply3G Ltd.
Sorry, but I think that is your problem. You should have issued against 'Simply Communications UK Ltd'. The fact that a company is no longer trading though, does not stop it from being liable for its debts.
For what its worth, I have done a search at Registry Trust, the organization that registers all judgements. The search was for Simply Communications UK Ltd and I used the Bagshot address. To my surprise, it came back with just 4 judgements. I would love to hear from anybody who does have a judgement because I can't believe there is such a small number registered.0 -
I registered mine as Simply Communications UK Ltd T/A Simply 3G so that there was no way they could say 'thats not us.' If they do bother to actually turn up at court (which I doubt) I cannot see that a judge would let them get away with it. As it is blatantly clear that they are one and the same company.
I am sure that the reason there is only 4 judgements outstanding at the moment is because of the length of time it takes for everything to filter through the system.
I received a cheque from them in September (last payment of last years mobile claim which was submitted in July) - so it has only been since September/October time that they have been having problems. If you take into account how long we had to wait for a cashback to be processed (45 days) plus a couple of week chasing, plus a couple of weeks after sending a LBA before issuing a MCOL - you are looking at 3 months or so. Then assuming Simply 3G acknowledge the claim - thats another month before judgement can be passed (providing of course that they dont submit a defence and waste even more time). I am sure that the number of judgements will be a lot higher this time next month.£2008 for 2008 club member 3360
