I have had some dialogue now with Surrey's Trading Standards but all they could tell me was the same as was posted far back in this thread (the email from Tim Tusler) and nothing more recent than that.
All my exhaustive enquiries both in Scotland and in England lead me to believe that Simply 3g or Simply Communications UK Ltd (they appear to be using both names) are working out of the Bagshot address and I have asked if it is possible for Surrey TS to visit the address.
I don't know if they do that sort of thing or not but considering that many people are affected it would be nice to know once and for all what the situation is and TS may carry some sort of authority than an individual does not.
I take on board what SteveC said in his earlier post - but my LBA was signed for at the Bagshot address only last week and I now have the electronic proof of delivery showing it was signed for.
I have now also submitted another cashback claim by SD - so will update on that tomorow as to whether it was delivered or not.
It may be better for individuals not to go to the address but to let TS do it in their capacity as TS. (If they will do it).
It will need more than just me emailing Surrey TS to get them to do anything (I'm not sure if their remit covers site visits) - but if enough of us contact them they may be able to help - or advise why they can't.

Richard, I agree I've seen many posts on other sites saying leave them alone let them work it out don't worry, I've had my LBA signed for Recorded like you, I had my last claim sent Registered and signed for only a couple of weeks ago needless to say I didn't get the e-mail confirming they received it. And keep the pressure up, how on earth they can continue to trade is amazing, my local trading standards won't do anything because Surrey TS will only tell them they are working!!!!! with the company. ICE thanks for the e-mail address just sent one too him now. I am not giving up although I think this company will ignore everything to the last minute, perhaps watchdog is the answer, they should be named and shamed big time. In reference to the deception comment I completely agree, and three would not do anything for me other than say It is the companies responsibility to pay cash back not us!!!!!!!.0

Hi Folks, joined as had to share this info, we have a total of 3 x 3 contracts and also no cashback (in the region of £900), so as my contract is up for renewal I phoned 3 to cancel but was told my 12 month contract was actually an 18 month, simply3g have fraudulently put my account through as an 18 month and its really difficult getting 3 to believe me, i do have paperwork but their fax doesnt work and even the local 3 shop had to give up on trying to rectify this. Just beware and its worth checking that all is okay with your account.0

Has anybody out there heard of the company simplyb2b - www.simplyb2b.co.uk registered address 40A UPDOWN HILL, WINDLESHAM, SURREY, GU20 6DX they used to use the same 0800 number as simply3g.
This company was also part of Simply Communications UK Ltd previously trading from Bagshot House. However in November / December applications were made to Companies House for being a registered company.
I still await a cashback claim but I am in two minds whether to follow MCOL route.0 -
sarah - if you wrote to 3 at the glasgow customer services address, they should get back to you in around 4 weeks going by my personal experience. If you sent it in december, give them a bit what with xmas and new year.......Gettin' There, Wherever There is......

larksapple - from the name, it sounds like that is/was the business arm of simply communications, with simply3g being the retail part of the business. Not an uncommon arrangement in the world of commerce. However, unlikely that you could make the b2b element liable for the s3g cashback.........Gettin' There, Wherever There is......

Sorry guys, impressed with all your efforts to get the money back but, looking at the way you people are pushing this company, what if it throws itself into administration.
At this point of time you all stand as unsecured creditors. Do you think this company have got that much assets to pay off around £3-£4 Million to pay the unsecured creditors who are at the bottom of the list.
They havent even got their own premises, all they might have is some computers and furniture which doesnot qualify for Auction.
And regarding the owner of the company, he will get away with declaring himself Bankrupt and within few months start a new business in somebody elses name.
This guy knows what he is dealing with here, these court sumons, trading agency are no good to you once he declares himself bankrupt.
So where the war ends, at an agreement, not a contract.
The best course of action at this point would be NEGOTIATION. Now, if you could get hold of him, try negotiate whether if he is willing to pay what ever money he owes to you in say 2-3 year installements with appropriate interest not much with installements starting 1st of every month.
With this he will also buy himself some time to get his business back on track which he is already trying to do and might pay off percentage of claim if not all.
Rest is all your decision because its your call.
