I take it the MCOL people will be in touch with me at some point and provide me a copy of their defence.
MCOL will only contact you if there is a defence lodged.

Thanks Quentin. I have read and reread the claimants guide over the past few weeks. I am hoping that they wont file a defence and are just stalling for time but knowing my luck they will. I am just not looking forward to the whole court thing.
From what I have read - i have interpretted the following - either they submit their defence which means we have to go to court (which I find a very daunting prospect) or they dont do anything and I can ask the court to make a judgement after the 28 days are up.
MCOL at the moment says that Acknowlegdement was made on 10/01 which by my reconning gives them till 7th Feb. If they havent done anything by 7th Feb I can click on the 'start' option that has appeared under the Judgement option. Does that sound about right?£2008 for 2008 club member 3360 -
No. It is from the date of service of the summons that the 28 days is counted after an acknowledgement is lodged by the defendant.
I am trying to get my head around the dates. I submitted the MCOL on 7/1 after 10am so it will have been dealt with on 8/1. They then allow 5 days for service of papers dont they? So that would make it 13/1 as the first day of 28? or do I still leave it as 10/1 as that was the day they actaully acknowledged the service?

The court should have sent you a Notice of Issue.
This contains the relevant dates (date of issue, date of service, and date defendant must reply by).
Add 14 days to the date the defendant originally had to reply by now they have filed an acknowledgement.0 -

Thanks Quentin - I have just re-read the Notice of Issue and they were deemed to be served on 13th so they had until 27th Jan to reply (which they did on 10th Jan). That then means they have until 10th Feb to file their defence. I wait with interest to see what they have to say for themselves.£2008 for 2008 club member 3360 -
Hi everyone,
I'm having trouble getting hold of my cashback too. Despite numerous emails and calls I've heard nothing. I'm owed about £130. I have today sent a pre-action letter demanding payment in full within 14 days or I will start legal proceedings without further recourse to Simply3G.
I have not received the emails some of you seem to have from Simply3G about their financial situation.

Well I'm fed up now with this. Having made exhaustive enquiries about Simply 3g it would appear they ARE still trading.
I have been in touch over the past few weeks with Companies House and today the Insolvency Service (both for England and the one in Scotland - Scotland because Simply 3g list their address as in Aberdeen despite still also telling cashback claimants to use the Bagshot address).
The result of the above enquiries is that Simply 3g have not filed for insolvency.
I have had no further communication from simply 3g despite emails and two letters sent by Special Delivery.
I initially sent the first letter to the Aberdeen address but Royal Mail were unable to deliver it and the enquiries they made with neighbouring businesses showed the people had 'gone away'.
I resent my second LBA to the Bagshott address and it has been delivered - but not replied to.
Despite my earlier misgivings about going down the MCOL route I think I now will - on the basis that I now have yet another cashback to submit and I have received nothing so far - plus the various enquiries I have made lead me to believe they are still trading. I am also tied to Vodaphone till May - who themselves are refusing to return my calls or answer my emails citing 'too many people in a similar situation and they are overwhelmed.'
I have yet to receive a reply to my email sent last week to the Trading Standards office which covers Bagshott in which I asked if they might be able to enlighten me further.
3 quick questions for anyone who has begun the MCOL procedure - or knows the answers -

Yes I am still submitting claims even though I am claiming for the full amount - there is no way I am giving them any grounds to reject my claim.
I haven't had a court judgement yet as they have filed an acknowledgement of service. Should hopefully know whats going on by the middle of February.
I have just sent my first claim for my other mobile with a very sternly worded letter stating that I will be taking the legal route as soon as they miss the first deadline for payment (and going for the full amount) as they would not hesitate in keeping me to the terms and conditions if i missed a deadline.£2008 for 2008 club member 3360 -
