Even that depends on the date it's taken from too. The date of their communication or the date you sign up to it? If I were considering the offer I would ask for clarification - though I suspect it will be toward the outstanding unpaid claim end of the spectrum and on that basis I think I'd agree with you. I don't think I'd accept just 40% of the outstanding claim paid over the next year IF they survive - although non-agreement is likely to ensure I'd get nothing. I can also see that it is quite likely the best they can do and that they are at least making an attempt. Not much consolation but more than some others did who went under.0

I would give more consideration to their offer if I could get Vodaphone to return my calls regarding changing my monthly payment.
I understand (from another thread) that some people were getting their monthly amount halved. I rang Vodaphone a few days ago and despite them telling me that someone would be in touch from their 'special department set up for this scenario' - no one has bothered.
Today my special delivery letter to Simply 3g was returned to me by Royal Mail (it was sent to the company address in Aberdeen - possibly in error but the Bagshot address appears only to be for cashback claims).
For those who have already issued MCOLs - what address did you use - and have you heard anything at all?
Meanwhile - I have been busy in communication with Companies House. It would seem that Simply 3g may be in breach of the rules as they are advertising the wrong address as the address of their company and so far it seems Simply 3g have failed to respond to C.H. enquiries as well.
I have also emailed Tim Tusler, Surrey Trading Standards to find out if there is any way T.S can see if the Bagshott address is still active and maybe obtain any further information.

I have used the Bagshot address as the system required an address in England (or Wales). Have had no problems so far and I received the hard copy of the paperwork in the post yesterday. Will keep you all updated if anything happens.£2008 for 2008 club member 3360 -
Well here is the latest update.
They have filed an 'Acknowledgement of Service' and intend to defend part of the claim. This now gives them 28 days to file a defence. I can only assume that they are defending the fact that I am claiming the full years worth rather than the two claims that I have currently submitted.
The form was signed by the MD but there was no printed name and the signature is illegible. The signature was also different to the one that was used to sign for my letter on 17th December - so there are at least two people working there.
The address they are using is the BAGSHOT one.
I am going to read through the threads for the Mobile Outlet/Mobile Rainbow et al to see what is likely to happen next (as well as the MCOL website). As I am really quite nervous (having never done anything like this before). Any hints/tips greatfully received.

We have 2 contracts thru Simply3g, and jointly owed £405 in cashback. One contract has paid back 2 cheques and the other only 1 so far. Could we look at a group action against S3G?
MCOL and SCC seem an option but added expense. I hve tried to contact on a number of occasions through email but not had any feedback since 11/12/07 when promised further info next day. Surprisingly nothing came!
We have not received the 40% offer, but is this only sent to those tryin MCOL route?

Well have submitted claim number one for my '3' mobile now with a very stern letter basically saying you have 45 days from the date of receipt of this letter to pay up or I start the whole legal process again. So roll on 28th Feb and all the fun starts again.£2008 for 2008 club member 3360

I have signed a contract with Vodafone by purchasing a new hand set from Simply3G with the option redemption cash back. But so far nothing paid to me. My initial 2 claims has been approved by them, but its been more than 2 months, they breaching the agreement. Wheneven I sent the mail, I used to receive the standard mails, What other innocent customer received.
The Problem is we have gone through this due to the offer of the money back, otherwise the monthly payment we now paying would have bring us a good latest hand set or more attactive free minutes. Its completly cheating the customers in the word of 'FINANCIAL CRISIS'. If we say to any companies/suppliers they won't leave us and take us to judicial action.
I just want to know, what and all steps I need to do for the court action, and how much this cost? .
Please advise.

Thanks for posting replies and proper advise too. I know many of us got impacted by losing big money, owe by Simply3G. Is any good way out there for, we all sign a group petition to the proper watchdog/trader association..., I'm not sure about that?0 -

I have just followed the advice given in this thread and threads such as the Mobile Outlet and Mobile Affiliate's one. MobileJunkie and Quentin have also been a wonderful source of info through these threads. Without them I probably wouldnt have had the knowledge/guts to go through with this. I definately recommend reading through the afforementioned threads (I know it will take a while so I recommend having a nice cup of tea and a choccie bar to hand.) The cost of the MCOL will depend on the amount of money you are claiming (in my case £420 per mobile for two mobiles so two lots of £35).
