Just wanted to say I have been reading this thread ever since we discovered in December that they no longer had a phone number - and owe us £210 in cashback up till the end of Feb this year. Our emails are getting no response at all now but I don't see the point in going to court if they're going under anyway, it'll irk me more if I lose more cash on the fees. We even tried saying we'd accept 2 out of the 3 cashback amount we're owed, but still nowt.
We have been in touch with 3 though and requested early release from the contract if we agree a new deal with them. This is looking positive, there's only 2 months to go but at least it may mean we recoup a wee bit of the lost cashback.

i don't think there is any point claiming anything through the courts at this point. You will just end up losing more money through court fees, and making sure that you lose all your cashback money by making simply3g bankrupt.
actually, the best plan of action is to get all your friends to sign up to simply3g... so they stay afloat & belatedly pay the outstanding cashbacks!0 -

We would like to apologise for the time in which it is taking to resolve your current cash back claim and we would also like to thank you for your patience and understanding whilst we are going through this difficult period.
As you are now aware our business has been experiencing severe cash flow problems for the past few months and we have been working to find a solution in order to fulfil our commitments to our customers and keep the business trading.
We have the following options open to us:-
1. We are placed into administration which would result in the unfortunate event of nobody receiving their rebates from us.
2. We work on an agreement with our customers that would allow us more time to fulfil your claim, allowing us to trade and generate the essential revenues required to pay your cash back claim. We propose to pay you 40% of the total money owed to you at this point. No further claims would be required on your part, we will calculate what you are owed at this point taking into account what you may or may not already have been paid. We would then ask for up to 12 months to repay you this agreed amount in instalments.
In order for us to pay any monies to you, we have to generate on-going revenue. The only way we can do this is to continue trading. You will have noticed that we withdrew from cashback deals in October but now offer very simple and straightforward deals. Sadly this does not generate high volume sales, but it does generate essential revenue that we require in order to pay you. We have identified a market place in which we can trade and generate revenue to pay you, but this will take up to 12 months which is why we are asking for this additional time to pay you.
This will then allow us to focus on generating sales, bringing in revenue and allow us to pay you.
Upon accepting this offer, we will write to you with a formal letter and then all claims will be processed and filed in date of order received. Once a month we will then start making payments. The first payment run would commence at the end of February.

Got that email too. Tempted to take it, better than nothing and I agree forcing them through the courts is just going to mean everyone loses out ultimately. Surprised to even get this offer really, I guess now it just depends when and if they actually pay out.0

Note there is no proposal to pay you any more than the 40% on offer (and it seems this will be paid on the drip over 12 months). It looks as though by accepting this offer you give up all claim to the remaining 60%.
So you are gambling on getting just 40% over 12 months against suing them for 100% (plus interest) now.
And of course they could fold at any time.

The way I read this is that they will only pay 40% of the money owed at this point - so if you are only 6 months into a £35 contract and have only just sent off the first claim of 4 - you would only be entitled to receive £42 ((£35*12/4)*40%) rather than the full £420 owed and that this £42 would be paid over the course of a year (even though you are still shelling out £35 a month to the mobile phone company).
I suppose it depends how far through your years contract you are.
Just a question - say you have just sent off your final claim for £105 after having received the other three cashbacks (£315) while they were still paying out. Does that mean that they would still pay you the £42 or as you had received more than 40% of the full claim they would say tough. Perhaps they would ask you to pay them back:rotfl:
They havent sent me an email as yet and I would like to tell them to poke their offer as I feel like its more of a threat than a sensible offer. I do worry however that MCOL would frown upon me turning down such an offer.

I sent a letter by Special Delivery yesterday to the Aberdeen address they are still showing as having on their website.
Royal Mail's Track & trace system shows they tried to deliver the letter this morning but were unable to. I tried to click on the option on the RM website to arrange a redelivery atempt but then the website kept crashing so I phoned RM.
They looked up my item and there was a note saying that the postman was told the people at the address had 'gone away'.
So it looks like Simply 3g have either already gone bust or are simply refusing ALL mail.
Has anyone who has already started the MCOL route heard anything?0 -

Yes - I used the Bagshot address as it had to be an address in England (or Wales). I sent a cashback claim there a couple of weeks ago and it was delivered ok. About to send another cashback tomorrow - so should know by Monday if that address is still working ok. Will let you know.£2008 for 2008 club member 3360 -
I too have sent my most recent claim to the Bagshot address. Posted Wednesday 070108 and confirmation of delivery is on the Royal Mail's website, but the "electronic proof" is not yet available.This is my third claim, no money received to date.I don't hold much hope of seeing any of it.0
