Deleted_User - I totally agree with you. If they were honest and up front with us I would not be getting my knickers in a twist about this. They promised that we would be informed by 10th December what was going to happen about our cashbacks - and as yet there has been on communication apart from the standard text that your friend received.
It seems like daylight robbery - they owe us all money (£840 to me), they still carry on trading as if nothing has happened and just ignore us when we try to find out when/if we might get any money. I cant see any other way than to either kiss goodbye to the money or sue them (which could be a waste of money as well).

I think only you can weigh up the options and decide. How much it could cost against how much you may retrieve for one thing. Then, what are the chances of getting your money. It's a risk-reward decision and no-one really knows the answer to that or what will happen - or when. Whilst i've only ever needed to issue two LBA's and got paid on both occassions - the first by a company which went bust two weeks later - this is slightly different. Here, you KNOW they're having difficulties and not paying and have said that if they are pushed they will have no choice but to go into administration. How many people suing will cause that to happen and how many will sue? All unknowns, but if the floodgates DO open I doubt you'd see a penny. There's no immediate need to act upon the LBA. You can only consider carefully and make your own decision on this. To be honest, if it were me I might have kept quiet on here and gone for it immediately or decided to leave it and hope they survive and then pay. Who knows which if either would have worked though? A stampede only succeeds in bringing the house down sooner rather than later or (just possibly) not at all. As for the other question, I bow to Quentin's knowledge.0

There's probably no point in going to Bagshot to see if anyone is home - I think they have moved to Abderdeen - even though the address for cashbacks to be submitted appears to be still in Bagshot.
I think this next fortnight will be telling for a couple of reasons -
1. The Christmas/New Year holiday is now finished and with any staff still working at Simply 3g they will surely be back at work.
2. Undoubtedly they have returned to see many LBAs and MCOLs - but hopefully also a number of new orders.
It is encouraging that they ARE still trading - otherwise why not pull the website - and the fact that no NEW cashback deals are being offered means (hopefully) that with new orders they can, given the time and opportunity, turn themselves around.
Even though I am owed money - and still have 5 months of my contract left I think as MobileJunkie says - suing will just bring down the house of cards and everyone gets nothing.
I therefore am not suing - even though I could - and whilst not happy about it - I don't beleive in throwing good money after bad in trying to recoup what they owe.
I think the lesson here is to look at mobileshop.com - (I had a cashback deal with them last year). Rumours abounded about the status of their company especially as cashabcks were being held back and they upset numerous people - BUT - they DID pay out the cashbacks and unless someone says otherwise - everyone HAS got their money back from them.
And....
they are STILL trading.0 -
Slight update...
I emailed Simply3g asking them to issue an up to date statement regarding cashbacks and they replied within one hour! However it was the same email as my friend got on 13th Dec - word for word.
I did however ask them if cashback claims are still to be sent to the Bagshot address, considering they have listed their company address as Aberdeen - and they said yes, send to Bagshot.
I have re-emailed them asking them to issue an up to date statement regarding cashbacks and quering why new customers can get cheque payments whilst cashbacks are not being paid.

Another standard reply from Simply3G. Have received this twice in my inbox this afternoon. Obviously they didn't read the emails as patience and continued understanding are not terms that really apply to me at the moment. However they have a reprieve for a couple of days as it seems that the MCOL system is still being worked on according to one of the other forum threads.
Does anyone know whether I have to issue separate MCOL's for the two contracts I have with Simply 3G or will one suffice?

Is it normal for companies to just completely ignore LBA's? I'm sorry but if someone threatened me with legal action I would at least acknowledge it (whilst shi**ing myself probably).
Still no phone call from the Vodaphone specialist team and 3 haven't been in touch since their initial 'we'll investigate call'. I just feel like I am being ignored£2008 for 2008 club member 3360 -
Very tricky situation at the moment....still trading maybe, but how well did they do on the run-up to xmas?? Will it be enough to make a difference, or will it be the final nail in the coffin? I've just had my regular offers e-mail from them, and the deals are still quite good BUT.....will it be enough to tempt more customers and so give existing ones more chance of cb, I wait with anticipation especially as my first claim is due to get sent once January's bill gets here...........Gettin' There, Wherever There is......

I am filling out my small claims form and wondered if anyone can help....as simply 3g are in breach of contract, am I able to claim for all outstanding monies, or just the debts that are overdue?

I believe that you are able to claim for the full contract - and don't forget to claim back the court costs and any other costs you have incurred.
I still cannot find anywhere whether I have to issue two separate MCOL's for the two contracts I have or whether I can just issue one to cover both contracts. This I will have to ring MCOL in the morning.£2008 for 2008 club member 3360
