    The words "blood" and "stone" spring to mind.
    As someone has said earlier the chances of a company "trading" their way out of insolvency are pretty remote so by taking them to court you quicken the inevitable.
    There is another saying about "throwing good money after bad" so if you cannot afford to loose the cashback then you will not be able to afford to loose court fees on top.........
    In my opinion the best way is to let them try to sort themselves out as it seems to be the only way there is even a faint glimmer of hope. All of the other options result is a definate "nothing".:confused:

  • grrr - they dont read their emails do they. I have just emailed them the contents of my LBA letter (LBA being sent to both addresses and also the email address so they cant say they havent received it) and they have sent me the standard 'thanks for your patience email' even though I clearly stated

    'Please do not send me another standard email thanking me for my patience as I am afraid I have lost all patience with, and faith in, your company'.

    I know sending the LBA probably wont do me any good in the long run - and it might be better to let them try and trade themselves out of the hole they have got themselves into - but at the end of the day - this money is owed to us and I am sure that the directors are not losing sleep over how they have affected their customers or the staff that have already lost their jobs when they closed the telephone centre. Anyway rant over - least I feel that I am doing something.

    In the unlikely event of this lot trading themselves out of trouble who, do you think, is going to get paid first? Someone who has been nice and 'patient' with them or someone who has the legal ability to send the bailiffs in?

    If you have decided you are prepared to risk the court fees etc you should do so asap. If they stay afloat you will get paid. If not you might be able to enforce judgement before they go bust. The longer you wait the less likely the later is.

    Usually when a company is insolvent it is the Inland Revenue, VAT, National Insurance etc who will have first call on any assets. Followed closely by any other secured creditors, banks etc. The humble supplier or cashback customer will be well down the pecking order, LBA or no LBA.

    This will also be true even if they do trade themselves out of insolvency. However, the reason that trading out is nigh on impossible is because the "brand" has now been terminally damaged. Do you see people flocking to Northern Rock even though if you did and they went bust you would be 100% protected by the government?

    It is a hard lesson but the chances of anyone seeing anything are very remote. I would love to be proved wrong.

    Perhaps taking them to court will make Sarahh112 feel better and if so then perhaps it a relatively small price to pay........

    I agree. I don't think this lot will be able to trade themselves out of trouble and will go bust. It is just a question of time.

    I agree. Cash back customers will get no money if they go bust.

    My point is that if Sarah112 has decided to take action she should do so promptly. I can assure you she will 'feel better' if she gets paid before they go bust!!

    I too have being having problems since august. awaiting cheques for my wife and I.

    Got fed up last week and put certain things into motion including emailed the afflicated ' so called' safe website organisations. Only one has replied and done anything about this. well done IMRG Ltd

    The corresponence i received was:
    I wanted to advise that ISIS Accreditation for Simply3g has been withdrawn in light of the recent difficulties the company are experiencing. I would recommend that you contact Consumer Direct on 08454 04 05 06 if you would like further advise on this matter.

    just checked out the website - doesn't it look pretty with the xmas animations over the name ?!?!?!? It looks like they're trying, but as has been mentioned earlier trading out of trouble can be nigh-on impossible. I hope they don't go under (vested interest, of course :D) but think the inevitable is just waiting to happen. The other danger sign is moving from surrey to....Aberdeen ?!?!?!?!? Hope everyone keeps this thread up-to-date as it will be very useful info.....

    I notice that their current offers on website that instead of cashback they will send a cheque with the phone. The amounts seem to vary between £15 and upwards. If they have cash to do this then playing hardball with them might pay off?
