    Alaways been good with my first 2 claims but i also got the e-mails in this thread after chasing them:mad:

    they were good with my cashback claims over the past year or so.. so i just took out a new contract a couple of months ago through them.

    looks like the deal was too good to be true... :-(

  • Hi AllI am still awaiting my first cashback cheque since October, despite receiving the "successful" confirmation email. My second cashback is due on 22 December.I emailed simply 3g on 12 December and on 13 December I received an identical reply to Sarahh112 - post #38. It looks like an automated reply is now being used.What chance have we got of seeing any of this money? My 3rd claim is due to be submitted soon. Is there any point in doing this?Has anyone contacted 3? Thanks in advance.

    So much from hearing back from them recently as they promised to update us by the 10th, then the 12th. Do you get the feeling its just stalling tactics.

    Have had no reply from them regarding my rather stern email stating that if they didnt respond to me by close of business yesterday then I was going to take legal action - so it looks like I am going to have to make good on my threat. I suppose my email doesnt count as an LBA and that I will now have to write them a letter and give them more time.

  • Mobile Junkie - I think your guide for dummies is a wonderful idea and am just about to send an LBA to Simply3G as they are messing me and loads of other people around at the moment and they still havent had the courtesy to reply to my last email (or even to update us poor fools like they promised they would earlier this week).

    I was just wondering if you had any experience of them at all and if so what you thought of them?

  • Hi Sarahh112. Never bought from them but was very seriously considering something a couple of weeks ago. was a relatively small risk though had I taken it - and most certainly wouldn't now (I always follow the threads closely before I take the risk).

    It's a pity; just about ALL the previously reliable companies are either bust or about to be so. I really do suspect this (happening at exactly the same time) has something to do with the networks stitching these companies up. There's been at least one dealer to specifically say that and it's too much of a coincidence simply to blame everything on a "bad business model" or a bunch of crooks. I am a victim too (though limited my losses and have to set them against a lot of gains) but I actually feel a little sorry for the dealers. They get blamed for everything from all sides - but people were quite happy to rush in without thinking in many cases.

    Simply3G have the appearance of an organisation attempting to survive - albeit it against the odds now. If they are in trouble (and they certainly seem to be) they could either go under (and get screamed at) or stop paying and ask for leeway (and get screamed at). It seems that they are basically saying that if people sue them for their cashbacks they will have no choice but to go under. That seems highly credible to me. In your situation I think I would send a LBA - but rather sympathetically. However, whether it's then worth the risk of spending money on court fees which you may be highly unlikely to recover is another matter should they not pay you. I think the rule has to be LBA if they don't pay on time without messing around. Get in quick (I did with Mobile Affiliates recently) while they are still paying. However, now they seemed to have stopped paying, full stop. Perhaps you have to weigh up how much you are likely to be out of pocket if you don't sue against the costs of suing and then pursuing a possibly lost cause. It's pretty much a no-win situation. If everyone sue it does seem likely you will all lose. A tough decision. Mahybe a quiet word with them privately would be a good idea - if you can get through. Stampedes and crusades are not a great thing for anyone - including the animals taking part. I wish you good luck - a pity that one fo the very few companies with a half-decent reputation is now in this position.

    Another factor is your network. Complaining to them en masse will simply bring the dealers' house down and is totally unwise. However, unless you're with Vodafone should they go under I don't rate your scale of help from them. I'm not at all sure this dealer had any (or many) Vodafone deals.

    Thanks for that Mobile Junkie. I have got two contracts - one with three (for me) and one with Vodaphone (for my daughter) - owing a grand total of £840 - which is a heck of a lot of money when you are off work on maternity leave :-(

    I do feel sorry for them (and especially for all the staff they have got rid of just before Christmas) - but I have repeatedly try to contact them via email and phone. They have removed all their phone numbers from their website and the numbers I managed to find through Google all have recorded messages saying that the offices are closed and to check the website. They are not responding to their emails now - even though they state that they will reply within 24 hours. So I wish I could speak to them.

    I have just finished drafting the LBA giving them until the end of the year to contact me, otherwise I will put in my moneyclaim on 2nd Jan. I just cant see that I have any other choice.

  • It doesn't sound good I'm afraid. The person on Vodafone is fortunate; if you read the rthreads on Mobile Affiliates and Mobiel Connections and all their subsidiary names you will find that Vodafone have been excellent in helping those affected by dealers going under. In fact, though they have gone back somewhat on the scale of their assistance it is still significant, rapid (based on previous collapses) and well above any obligation to help some people see them having. Unfotunatley Three seems to be the worst of the networks so you can't help for much joy there. In any case, no help will be available (rather the reverse effect) should people approach them now. I'm afraid it's better under these circumstances to assume that no cashback will be forthcoming and try to come to terms with that as soon as you can - without giving up trying to obtain what you can. In fact, as a thought and although it goes against the grain maybe you could consider offering the company a deal; a proprtion of your cashback and forfeit the rest. Not many would do that, but it might be tempting to the company if it can reduce its liabilities in that way - provided it had enough resources to do it, which it may well not have. Just a thought. You need to gear yourself up to cutting losses perhaps.
