At this point of time you all stand as unsecured creditors. Do you think this company have got that much assets to pay off around £3-£4 Million to pay the unsecured creditors who are at the bottom of the list.
They havent even got their own premises, all they might have is some computers and furniture which doesnot qualify for Auction.
And regarding the owner of the company, he will get away with declaring himself Bankrupt and within few months start a new business in somebody elses name.
This guy knows what he is dealing with here, these court sumons, trading agency are no good to you once he declares himself bankrupt.
So where the war ends, at an agreement, not a contract.
The best course of action at this point would be NEGOTIATION. Now, if you could get hold of him, try negotiate whether if he is willing to pay what ever money he owes to you in say 2-3 year installements with appropriate interest not much with installements starting 1st of every month.
With this he will also buy himself some time to get his business back on track which he is already trying to do and might pay off percentage of claim if not all.
Rest is all your decision because its your call.

Dear Justin
The whole point of me doing this is because I (and countless others) CANNOT get hold of Simply 3G. They do not have a telephone service any more and will not respond to letters sent via email or snail mail. Trust me if I thought there were any other means of getting my money back I would not be putting myself through the added stress (and cost) of court claims.
If Simply 3G were honest with us and actually kept in contact rather than hiding away I would be more than willing to hear them out - however the information that we were promised we would receive on 10th December has never arrived so why should we just sit down and be ignored while they are dining out on the money that we are owed?
So I will continue with court action in an attempt to recoup my money and if that sends them into administration - least I will know that I have done everything I can to get my money back.£2008 for 2008 club member 3360 -

Yes, U R Right, I have just joined. I have been keeping an eye on this issue since quite a long time, being working on the Legal side of Corporate Finance, I am always interested and keep looking for issues like this.
This time after looking at your efforts, some how I got interested to find a way getting your peoples money back. Looking at the big picture I have justfied your stand in legal terms.
If your efforts are motivated towards the social reponsibility, then I would be happy to take a back seat but if the concern is money I dont thin its worth spending time taking a legal course.
Writting to 3G Head Office might effectively result in black listing the dealer ( somewhat happened to www.themobileoutlet.co.uk, I am not sure), but still wouldnt get the money back.
Other independent organisation has already acknowledged this issue years ago attracting reports by BBC and Channel4.
Obviously whats happening is bad and is a good lesson for those keen to stretch their budget
Life has to and should move on getting over issues like this as an everyday lesson learned.
But I would still stay there is a good possibility of getting everybodies money back but certainly not through legal action, which as well might lead an unfair decision to those sitting back hoping good.

Ok - latest update - HOT from Trading Standards in Surrey via my local TS this morning.
Simply Comunications UK Ltd are trading as Simply 3g - (you need to put this on any Court forms).
The ARE still trading.
I'll repeat that.
They ARE still trading.
Also , my latest SD cashback claim was signed for today.
Their problem (which presumably has lead to all of our problems) is with the phone company 3.
I (and TS) do not know the nature of the problem with 3.
However - the Bagshot address is still active.
If 3 are the problem - this gives Simply Communications UK Ltd (Simply 3g) the possibilty of taking legal action against them - depending of course on what the problem is. (I'll hazard a guess at unpaid money but of course it could be anything).0 -

In an ideal world Trading Standards will have convinced Simply 3G to be honest with its customers and give us some sort of official update rather than hide away and pretend its not happening.£2008 for 2008 club member 3360 -

Thats great if they are still trading, but as I said yesterday, I spoke to the court bailiff who said that a colleague had been there to try to execute a warrant, but was unable to due to the fact that they had gone away and in her words, had "ceased trading".

The info has come to me via my local TS office this morning. I rang Consumer Direct yesterday as the Surrey County Council number seems to direct people to Consumer Direct - however CD then contacted my local TS office who rang me (several times in fact as the enquiry progressed). I also mentioned that Court bailiffs had said that the company had ceased trading and that the sole aim of my enquiry with TS was to confirm this (or not).
They then contacted the Surrey office and then my local office again rang me this morning having had more dealings with the Surrey office.
I do not know if anyone has physically visited the premises but it was definite (or as definite as could be) that the company ARE still trading and the Bagshot address is still active.
In fact it must be active as someone there signed for my latest cashback claim only today.0 -

I am sorry but if we are all doomed to not getting our money which is where we are now, then let him go bankrupt at least we all tried. I found your comments somewhat unjustified.

As a new member on this site I have been reading of all your problems with simply 3g and I now realise why I am getting no reply to my emails!!! I am fortunately not awaiting any cashback but just a free gift of a 2gb memory card. Don't think, after reading this lot that I have got much chance of getting it, do you??
The 'invisible man' people are refering to must be Sam who actually last replied to me on the 2nd of January - the last time it seems he has replied to anybody - some 22 days ago when he promised me my upgrade phone & gifts by that Friday.
I should explain that I have been a customer of 3 phones for about 5 years now because of the incredible deals and by far the cheapest mobile phone packages accross the board. (I dont work for them by the way)
I did in fact receive my phone on that Friday AND a £30 cheque (YES) and I have paid it in and it has cleared!!!!! But, alas, the memory card was apparently 'to follow' as it was 'currently out of stock'.
Now, some 3 weeks and 7 unanswered emails later, I am still waiting for it. Hey Ho - suppose I'll just have to buy one now for 25 blooming quid - GRRRRRRRRR. But at least I can use my other free gift to pay for the free gift I did not get. And it is still bette than the basic phone upgrade I was offered by 3 themselves.
Can't believe though that invisible Sam is still 'HOIKING' people in with promises promises with no contact phone number, no HELP link facility, and no email. Should definiitely be stopped now! I worked for a boss like him for 10 years, take take take, promises promises promises, then he took the bloody lot and made me redundant last year! GRRRRRRR. I hate these bloodsuckers!
