You dont have to, I spoke to my barrister in depth about this last year when I won two court cases ( one in the high court ) using recorded telephone conversations.
The law is very very clear on what it required.

Thanks for that swilliam, that's very interesting... It mentions a third party though, couldn't that be deemed as a court and the recording therefore having to be declared?0

Well I just pulled out the original document of the Vodafone contract to see the T&Cs again.
In clause 1, it clearly says that"Mobile Device" means your mobile phone or other equipment and the SIM card used to access the services.
There is another quote on the front page bottom, in Summary of the Most Important T&Cs:2. What is this Agreement for?
This agreement is for your SIM Card and the minutes, texts, data and the services that you use. This Agreement does not cover the buying or maintenance of any mobile equipment that has also been provided to you. If your mobile equipment stops working, is lost or stolen, you must still keep to this Agreement and pay the monthly line rental charges until this Agreement has ended.
So the mobile equipment is your property, and as such Vodafone "sold" it to you for whatever amount it says on the receipt (£0 if was free with the contract taken out).SAY NO TO INJUSTICE !

Why dont you all turn up at VF Headquarters in Newbury and complain about this matter in person?
Personally, I have been happy with VF so far. Transferred to them from T-mobile.
Vodafone have done this:They credited my bill with £150 to match the Quidco deal as I couldn't order online via VF's website. I put my address in wrong and it threw up problems so they had to manually order my package via telesales. That was MY fault NOT theirs and they kindly gave me the £150 to my bill I would have got via Quidco online cashback.
:DThey credited me half a month's line rental (£15.00) when DPD delayed my parcel. Not VF's fault.
:DThey enclosed a 16GB memory card as there was a delay with the HTC Desire (not that the delay bothered me much)
:DThey exchanged without quibble my HTC Desire for a Nexus One and did not alter the tariff from the HTC Desire one. That said the N1 tariff comes with 1GB of data not 500MB so I ought to change voluntarily maybe.
:DThey credited me £10 as my number did not port across on the day they promised. One day later. This was T-Mobile's fault not VF's. A minor matter really.
So far my bill is £177.50 in credit.0 -

In this case a 3rd party is someone outside of a court, legal rep or anyone who is not involved in the issue.

yeah they can be fast when they want to. Somehow confused as to how giving the phone number of their own Customer Relations on their own forum would be deemed a problem but they do have their very own and very weird logic! Soon we won't be able to say "191" either on there lolNow free from the incompetence of vodafail0 -
