HTC Desire Vodafone 500mb Fair Usage Policy

Well I just pulled out the original document of the Vodafone contract to see the T&Cs again.
In clause 1, it clearly says that
There is another quote on the front page bottom, in Summary of the Most Important T&Cs:
So the mobile equipment is your property, and as such Vodafone "sold" it to you for whatever amount it says on the receipt (£0 if was free with the contract taken out).
Thanks for clearing that up. Do i risk (or indeed have the patience) phoning them up again and being put on hold for another hour to have to reiterate all my previous points and notes in order for them sort this mess out?0 -
Have you already called? What was your progress?
I called only once, on Saturday, to ask when we'd be given notice of the changes. Since the answer was along the lines of "we haven't made any changes, so we don't know if/when there will be notificiations" I resorted to email. As I've said on the eForum, I'm sticking to only communicating in writing with them, then I have a nice paper trail to show how they are not answering the questions asked, contradicting themselves and all the rest. Now free from the incompetence of vodafail0 -
Just received my first warning for having a post deleted on the Vodafone eForum.
I have also just lodged a formal complaint with Vodafone on both the introduction of these new charges and the way it has all been handledAndy_Wicks_Complaint wrote:Vodafone's handling of the introduction of new charges to allow them to enforce their existing Fair Usage Policy.
The latest update includes incorrect information....

17) When will I be notified of these changes taking effect?
There are no price changes – we’ve always said in our Ts&Cs that customers will be charged out of bundle (see our terms and conditions) .
I am not disputing that the Terms and Conditions state that we will be charged for 'excessive' use. What I am disputing are the charges. It has been stated before that there was no charging structure for out-of-bundle charging.

There isn't currently a standard rate published
Therefore, the charging structure of £5 per additional 500MB is either a new or an increased charge. As such there is most definitely a change being made.
My current position is that, as Vodafone have announced they are increasing my charges, I am entitled to terminate my agreement without penalty based on these announcements made by Vodafone. In stating that I am not entitled to terminate Vodafone are in breach of the English Law which governs the contract I have with them.
As consumers, we have been lied to by many different people at Vodafone during the handling of this issue. The forum thread discussing this issue has 1565 replies and over 90000 views as I write this. The thread can be found here:http://forum.vodafone.co.uk/topic/57718-mobile-internet-will-the-500mb-allowance-be-enough-for-internet-usage/
Vodafone must come out with a clear statement confirming that no changes are being made or admit that they are and allow us to exercise our rights as consumers. The current statement only acts to contradict itself by confirming new charges are being introduced and then stating no changes are happening!
If a timely, satisfactory response is not received then I will have no option but to take up this complaint with OTELO as well as seeking legal advice.

Well i've just installed 'recaller' on my n900, so I WILL be recording any telephone conversation I have with them. I wont tell them either, you are allowed to do this as long as I dont share it with a 3rd party.0 -

Welcome to the clubEdit: I'm on a final warning lol, they were kind enough to allow me an "extra" one

I think I might just do that very soon. Seriously running out of patience with them now.Now free from the incompetence of vodafail0 -
I have just had an interesting chat with Brett from customer relations. (All recorded although I can only use it between my self and vodafone as I didn't advise them i was recording)
I asked him about the £5 per 500mb being a change and he admitted it is an introduction of a new charge.
I then asked about cancelling, and after going away for a period of time, he said for now I wouldnt' be charged, however if in future I continue to go over, I will be contacted and they will chat about options. I told him I would not agree to £5 per 500mb regardless, and he said OK, well one of the options when they give you a call will allow you to terminate your contract with no penalty and receive your PAC code to go to another provider, however you cannot do this until you get the phone call.
I have this recorded so they can't go back on it now!0 -
p.s Ive also been given a warning for getting a post removed lol.0

Ive had a post removed although it was about nothing really. Does anyone know a working program for my desire that will record the calls ?0

Nice one mate... Why don't you call them back again and enquire about the fact that it says you need to cancel before the charge is introduced?
It'd be interesting to see what they'll say to that!0 -
