HTC Desire Vodafone 500mb Fair Usage Policy

looks like their servers will be even more flooded over the next few months, with all users trying to get over 500mb.. LOL
not a wise move vodafone0 -
Anyone considering taking vodafone up on the offer of being switched to the 1gb plan, be aware this is a hard cap, so you will be charged the second you go over.
Where as on the current 'unlimited' option you can exceed 1gb and not be penalized.

Taken from the Vodafone eforum:I imagine that this post may get removed because although it is free advice I suspect that it is strongly in opposition to the Vodafone's wishes. I've waited to post it until a few people get a chance to see it before it probably gets removed.
If I may politely point out:
I think it has been fairly well established that the proposals from Vodafone constitute an actual change in your T&C's which is to your disadvantage. Vodafone just don't want to change the wording at this point because it would mean an instant let-off from the remainder of your contract.
So now they are trying to sucker you all into accepting anything, just anything, rather than have to live with 500mb/month.
I personally would suggest that you accept nothing. No change is acceptable. What you had before was perfectly ok. You are being fooled into accepting the lesser of two evils, when there is no reason to accept any change.
Vodafone are tied into a contract with you which they cannot vary to your disadvantage without 14 days notice and without giving you the chance to tell them, "no way, I'm outta here".
I advise that you think very seriously - before you agree to anything - just what you are giving up and what you are commiting yourself to : i.e. a contract with a different set of terms & conditions.TESCO EVERY LITTLE change to the t&cs HELPS0 -
I myself have been verbally promised by Tom_Vodafone that i will be able to cancel the minute i receive notice that i am to be charged.
I've had this via email also - since i specifically asked for confirmation as being told something on the phone is pretty much worth nothing.
Though i must say that if i was told something verbally, clarified it, double checked that i had understood, and then Vodafone went back on it later - well they could pry any charges from my cold dead fingers before they could have them
I've got to wait in at home this morning, but after lunch if i haven't heard anything more then i'll email Tom again and i will step things up a gear.
It's funny to me that i was really trying to be as reasonable as possible only 7-8 days ago, give Vodafone all the chance they should need, and they still ballsed up my account, and have done nothing in regards to the issue of a limit on mobile internet.
Has anybody else found themselves speaking to Tom at Vodafone and being told alleged "inside information" but to keep it quiet? I took the details with a large pinch of salt, but decided to believe the intention for now. Apparently as head of the webteam Tom is privvy to certain things that normal 191 staff are not, and also the staff in the Vodafone Directors Office too (the people who have been replying to emails to Guy Laurence since this issue started).
Most of the people i speak to say very clearly "you can believe what i tell you", and then another member of Vodafone staff says something similar!0 -
My saga with the complaints department continues.
My original question:Andy_Wicks wrote:The facts, as I understand them, are:
1. There are no existing out-of-bundle charges in place for a customer who has Unlimited Mobile Internet (with 500MB FUP) in their contract
2. Vodafone have confirmed that they are introducing a new charging structure for customers who use their data allowance.
3. This new charging structure constitutes a change to the Terms and Conditions which were in force at the time my agreement was signed with Vodafone last year.
4. This change to my Terms and Conditions will put me, the consumer, at a significant material disadvantage. As I consumer I have the right to reject these changes and have written to Vodafone to notify them of this.
5. Vodafone have confirmed that, despite me informing them of my decision to reject the changes, they are going to implement these.
6. As a consumer, I have the right to rescind the agreement without incurring any penalty charges.
If you still believe that I am incorrect, I would greatly appreciate a response explaining where my understanding of the facts fall down.
Their responseFor out of bundle charges please refer to http://forum.vodafone.co.uk/index.php?showannouncement=137. I know you've seen this before and I know this announcement was made on 19 May 2010. Prior to this date the out of bundle charging rate wasn't announced.
I'll copy and paste the facts, as you understand them, and respond to each one:
1. There are no existing out-of-bundle charges in place for a customer who has Unlimited Mobile Internet (with 500MB FUP) in their contract
Response:
Agreed.
2. Vodafone have confirmed that they are introducing a new charging structure for customers who use their data allowance.
Response:
If a customer approaches 500MB of data use in a month then we will send them a text to let them know. If a customer receives several of these alerts we will contact them and give them the option of moving to a different price plan. If a customer stays on their existing price plan and continues to exceed 500MB of data over a longer period of time then we will charge them for the additional usage.
3. This new charging structure constitutes a change to the Terms and Conditions which were in force at the time my agreement was signed with Vodafone last year.
The terms and conditions of the airtime agreement between us remain unchanged.
4. This change to my Terms and Conditions will put me, the consumer, at a significant material disadvantage. As I consumer I have the right to reject these changes and have written to Vodafone to notify them of this.
See my response to 3.
5. Vodafone have confirmed that, despite me informing them of my decision to reject the changes, they are going to implement these.
See my response to 3.
6. As a consumer, I have the right to rescind the agreement without incurring any penalty charges.
Clause 11 of the airtime agreement allows you to end the agreement if certain conditions are met. None of these conditions are met so you can't end the agreement.
Is it me, or does he contradict himself yet again with this latest response. We have now got it confirmed that there were no out-of-bundle charges prior to 01/06/2010, then he confirms that new charges are being introduced for out-of-bundle usage at a rate of £5 per additional 500MB (taken from the link he provided) and yet he then goes on to state that there is no change being made??!
I have sent the following in response:Andy_Wicks wrote:Many thanks for taking the time to reply. However, I still disagree with your viewpoint.
You confirm that there were no out-of-bundle charges prior to 01/06/2010. You then state that the charges from 01/06/2010 will be £5 per additional 500MB (taken from the link you provided). These two parts I understand. What I don't understand is how you can then state that there is no change to the Terms and Conditions of my agreement with Vodafone when the pricing structure forms part of the agreement. As such, my understanding of the facts as posted in my previous emails remain unchanged.
+++++++++++++++++++++++
1. Your agreement with us is made up of:
(a) the Pay Monthly Airtime Terms and Conditions;
(b) the Pay Monthly Price Plan guide (available at https://www.vodafone.co.uk or call 191); and
(c) the Price Plan Terms for “Vodafone Your Plan” and the terms and conditions of any optional extras you may choose.
+++++++++++++++++++++++
Since my understanding of this situation remains unchanged, I again request to terminate our agreement without incurring any penalty charges.
If you still disagree with my understanding, can you please issue me with a letter of deadlock, as it is clear that this issue is not being resolved through the Vodafone complaints procedure.
Let's see what they come up with this time.

Another mod has just stated that it is changing from a FUP to a cap!Lee_Vodafone wrote:Posted Today, 03:46 PM
Hi emmadw1,
Your bill is pretty self explanatory really, the reference here is to your plan that has unlimited texts with a fair usage policy of 3000 per calendar month, and then mobile internet.
AndyWicks is correct too about the mobile internet changing to a cap, rather than the old fair usage policy terms.
If there's anything else, just let us know
Cheers,

Andy0 -
I am still awaiting my first text message.
Upon receiving this holy text, my plan of action is to:
- Email VF asking where did they define FUP excessive usage,
- Where are the charges announced in my contract T&Cs.
Can someone comment, if this is a fair plan of action ? And anything to improve on this ?SAY NO TO INJUSTICE !

ok am also involved in this fair usage sagger with vodafone. yesterday I phoned and spoke to someone in cs and she told me I had unlimited internet on my phone after I had played it dumb as though I wasn't aware of this on going sagger. Now I asked her to send that information of unlimited internet to my phone as a text and she said sure but after talking to her I noticed she had just sent a link to terms and conditions which was pointless to me. So today I phoned again spoke to someone first and they went on about the 500mb limit and I cut of, rang again and this time spoke to someone who mentioned I had 1gig of data on my account and when I queried insisting I was not aware of that 1gig and as far as I was aware I had unlimited, she then told me to hold and I knew I would not be going anyway with her so I immediately hung up and called again, this time round was told I had unlimited but it had fair usage of 500mb and if I went over my services might be restricted or I might just continue using my internet. Now when I asked her to send me a text confirming what she had advised me she started dithering and I then advised her I was recording the conversation anyway so she fell for it and she tried to delay giving me the crap the text might take 24 hours to arrive in which I then insisted on her sending me an email and when she figured out I wouldn't bug she sent it and it states "confirmation that you have unlimited internet with fair usage 500mb. if you go over your services might be restricted and if it happens 3 consecutive times you,ll get a call from us to discuss internet alternatives. Now what's more interesting is that when I was talking to this cs I could hear my phone ringing and it was the other cs I had cut of trying to call me but I wouldn't answer. And after I was then surprised to discover that I had two conflicting pieces of information on my account the first text above and the second text from the cs I had cut of then stated "greetings sir we tried to contact you again sir but we were unable to get to you and you actually have on your 3 lines internet service but it goes up to 1gb and we Cal it here unlimited for this specific size". And these two texts are within a minute of each other seriously I can't believe vodafone but am going to keep these with my life have sent them. to my wife's phone, and thanks to android have saved them as well on the Google server and this clearly shows yes vodafone have made changes but they haven't got a clue themselves what's going on and am going to use these two contradicting texts if they start charging me seriously vodafone is trying to shaft us. Might just call again to see if they can screw themselves further but I think I have got enough for now what do you guys think sorry for the long text but thought someone might benefit from this thanks.0
