What I think is wrong here, ASIDE from the fact that T-Mobile seems to be providing conflicting information, is the fact that T-Mobile's "direct" offer as opposed to what is provided via a re-seller affects the capability of the Device's operation. IE Speed and amount you can download.

If this was an offer where you get say a free headset for example with T-Mobile and not with a re-seller this would be different in my book. This does not directly affect the Device's ability to operate on its own correctly.

For example a Vauxhall Corsa LX has the same top-speed no matter which Dealer you buy it from. This kind of thing. However different dealers may provide free Mud Flaps, a roofrack. These do not affect its overall capability.
I don't agree with this analogy. Of course all Corsa's are capable of the same top speed, but GM sell them in countries with different speed limits. We by lots of devices and equipment which are never used to their full potential. Many people will never use more than 1GB and will be happy with less than maximum speeds. Apple, Symbian and Windows mobile device users only get 1GB (not sure about speed). Are they all being mis-sold too?

Actually, the Desire is capable of using an awful lot more than 3GB a month and is capable of faster speeds than UK networks can realistically provide. Should we all complain?

I suspect that the problem with resellers is that they are not selling you a T-Mobile phone and contract package, but are selling you a phone (under their own terms which may be free if you buy a contract at the same time) along with a separate airtime contract. That airtime contract may have different T&Cs to the T-Mobile Android package - T-Mobile might not even know what type of phone you have been sold as they merely provide the SIM card.

It's like buying separate flights and hotel accommodation rather than a package holiday. You might end up on the same plane and in the same hotel but you might pay less, but lose out on the free children's place and holiday rep 'services'.

Correct to a fashion, however, the airtime contract is subject to the companies t&c. In the case of mobiles & t-mobile, the mobiles website directs you to t-mobile to check the terms.

I couldn't find anything about the reduced limit and it took sometime to get my contract corrected, but it did get done.

In my opinion, the contract to provide my Desire is between Me & Mobiles, the airtime contract is between me & t-mobile. T-Mobile state with a smart phone you get a 3gb cap.

After my experience today with T-Mobile trying to get some cretin from god knows where to understand this issue I wouldn't care if they offered a 20GB limit. I still wouldn't bother with them. I am glad I have experienced this. (A) It shows the quality and level of training of their service centre staff. Both abroad and whoever is left in the UK and (B) That in my book they are not upfront with people.

Why have they clearly not put on their website sales area by Android Phones "You get 3GB buying direct with us and 1GB with a re-seller"????? To me that isn't upfront. Also why are people getting mixed advice about this from T-Mobile???

What I will say for Vodafone is they do state quite clearly that the limit is 500MB. And I wouldn't be surprised if they don't increase this at some point.

As an Aside. Finnish operator Sonera quoted me for 40 Euros pcm 500 mins X Network in Finland, 300 SMS Messages and 200 Mins roaming in the EU and 1GB Data usage in Finland and 350MB Data Roaming in the EU. Also NO stupid offshore call centre. But I can speak Finnish and their operators speak GOOD English!!!! :D:D:D:D:T Oh and this was a 12 Month term not 18 or 24!

This may be the best example yet of how ridiculous unlimited is

Not only does unlimited mean different things on different networks and different sanctions if you go over their definition of fair usage we even have different FUPs according to which dealer you used

We as consumers are being badly let down by the watchdogs here

No; 3GB with an Android phone, 1GB with all other smartphones. Your airtime contract is with T-Mobile, but it might not be the T-Mobile direct Android contract. However, if the reseller is telling you to check T-Mobile for T&Cs, then that's what you are entitled to. But it is the seller who is liable for resolving any problems, so if you buy through a reseller, the obligation to resolve issues lies with them.

    1. I emailed T-Mobile and asked about this and they replied that they weren’t sure.
    2. I emailed the 3rd party supplier who said they provide 1Gb (3GB is an extra £5).
    3. Telephoned T-Mobile (as I wasn’t convinced my question was properly understood) and was told that if I use any proper 3rd party supplier (P4U was mentioned as an example) then I would definitely be entitled to 3Gb (as that is the default for Android phones as per the T-Mobile website).
Still not sure what to do...

PS - Following on from Keith's point the following is from the
    the 3rd party supplier's wesbite T&C:
No right of cancellation exists for Goods where you have agreed to a connection or service contract with a mobile phone network as specified in that networks separate terms and conditions.
I would read as the contract for the phone is with 3rd party and the contract for service is with the network, hence being entitled to 3Gb.

    My experience is completely different.

I got my Desire from mobiles.co.uk which arrived on Monday. On T-Mobile with 900mins, 500txt, unlimited internet as the Free Booster - 24 month plan @£30 (cash back via Mobiles.co.uk at 6, 9 and 12 months)

After reading this thread I thought I'd call T-Mobile on 150 and see what the situation is.

The Welsh girl (fantastic a UK call centre - whoot!) listened to my query and said "yes no problem we can sort that out" - she explained what has been happening.

Apparently, if you pick the Web tariff then on your Android phone you should have the internet/data included in the tariff and not as the Free Booster. If it's added as the Free Booster then it's the 1GB FUP.

What should happen is that you get Xmins, Ytxt + internet + another FB and this is the mistake that some 3rd party suppliers are making when they set up the contract.

As I say mine has been changed - took the unlimited landline calls Free Booster.

Have to say both times this week when I've called T-Mobile I could not fault them at all - looking forward to being a T-Mobile customer and hoping if the Orange tacke over goes through that it doesn't go down hill.

Much more positive experience than my recent Vodafone and 3 experiences.

I notice on some Vodafone related threads that Official Vodafone representatives reply with advice.

Isn't anyone from T-Mobile on here who can provide an official definative answer?

i know my answer is right but i appreciate its not what you are looking for. This thread isn't regulated by t-mobile, anyone can disagree with my comments and say the opposite (which they are fully entitled to do). You should email them using the address I provided if you want a definitive answer, rather than on here. Only vodafone post official responses on here.

Ask them to look up the andriod internet promotion and read through the text. This is what they did and the text says its direct customers only. I've explained it from a business perspective (from my own understanding) why direct customers get different deals. I appreciate you disagree but I am just passing the facts.
