Hi and Happy New Year to all fellow GoGetters!
I would like to talk a bit about my story and how far I have got and haven't got so far...
I used to be with the Clydesdale in Scotland when I lived in Aberdeen. I now live in Peterborough and closed the Clydesdale account about 2 yrs ago. I have hit them for just over £2000 of charges and I want every penny, as they made my life quite miserable when they slapped their pathetic charges on me for going a few quid over the limit. It became Catch22, them telling me I was a naughty boy,and shouldn't spend beyond my means etc. then whacking me another £22.00 or more for the priveledge! How can you ever be expected to clear your feet?
Anyway, I believe I have two distinct advatages in my favour: Firstly, as my account is already closed, they can't get awkward and close it. Secondly, I am very fortunate in that for some reason I kept all my Bank Statements going back 16 years, so I don't have to ask them nicely for this info, and possibly giving them any advantage.
So I have already fired off the first letter, asking for my money, and had the standard, long winded and pathetic response about charges being justified, in the terms and conditions blah blah.I have now sent the second letter, giving them 14 days to pay in full or expect court action etc. This went over the Christmas period, the 14 days are just up now and no reply. So I aint going to mess about, it's time to start the court proceedings.
But now I have discovered a small problemo... This is where I need help/ advice from those who are further on. Seems I have to use the Scottish Small Claims System, as opposed to the English Money Claim one? Or is this only the case if you live in Scotland and are making the claim there? I live in England, but the bank is a Scottish one. Also, much to my dismay, seems I can only claim 5 years instead of 6, which will knock a bit of a dent in the amount I am due. Is there a way round this, I really need every penny of what I am owed.
Also, has anybody got wind of what the banks intend to do in the long term to stop these claims? Obviously they are losing an awful lot of money, but I often wonder if they are working on some grand plan to stop it all. When I hear about all their various delaying tactics, could it be that they are buying time to shut the door permanently? This is why I would urge everybody who is owed money to put in their claim NOW. So that you aren't one of the ones that gets shut out if and when the DO find a way of blocking us. Also, the more folk that claim and hassle them, the better for us all when they get bogged down, which is what they deserve!

Yes you can claim statuatory interest but ONLY once you are filing a claim with the courts;
You will need to include the following section in the particulars of claim;
'Interest per S.69 County Courts Act 1984 of 8% - £xxx [enter interest total at date of claim] continuing at 8% until judgment or settlement at a daily rate of £0.xx;'"He's a maniac, maniac that's for sure,

If you live in England you use the English court system and use Money Claim via the online system and can claim up to 6 years.0 -

Claiming £427.68 inc interest + £50 court Fees
This is the first one i did back on the 30th August, they offered me £180 good will gesture which they credited to my account, even though i rejected it. went through MCOL and took them to court on the 27th September and they filed a defence, so got transfered to local court in Leeds. Im STILL waiting for a court date as the Leeds court say they all bank charges cases are being passed to the "mercantile" court where they will all be heard together by one Judge to possibly set a presedence and they are awaiting High Court direction on when and how to do this. I was starting to lose heart on this one until today.........

Claimed £1341.00 + £324.54 Interest + £120 Court Fee
Paid The lot!!!!
Offered £596 as gesture of good will last month which i rejected, so took them to court through MCOL just before Christmas, they acknowledged the claim so had another 2 weeks to file a defence but checked my account and they have paid in the Full £1785.54. Started this way back on the 30th August too, but just kept at it and at last has paid off.

Claimed £700
Offered £296 , i had accepted this just before christmas as i seemed to be getting nowhere and could do with the cash
Did all this through MSE/CAG websites and now couldnt be easier with martins new pages with all the templates on it.

Hi every one, just a quick query if any one can help, from me starting to reclaim my charges from Barclays in june of last year, i got my allocation letter and paid the dues, the case was moved from northampton to my local court in Wakefield, who say they can not deal with it, and sent it to Leeds county court, on the 24th Oct 06 is this the "norm" and it has seemed ages since i have heard a thing from anywhere, so i was wondering if any one had the same sort of response from there county court0

This is strange. Your local court is a county court that deals with these type of cases. Did they give a reason why they couldn't deal with your case?
I would ring the court (Wakefield/Leeds) with your case number and ask how it is progressing. The staff are normally very helpful.How many surrealists does it take to change a lightbulb?

From your previous questions Barclays obviously entered a defence did you fill in the Allocation Questionnaire?- It defends the claim. If you’re one of the rare cases where the bank does enter a defence, don’t worry too much. You’re now in the Court process. There’s a straightforward form called the Court Allocation Questionnaire which you need to fill out and return to Court. If you are in this boat, there are many consumer organisations willing to provide help and guidance and back you up, see further resources.

Are you using Martins letters or CAG ones? on the CAG site there is a court pack (although it still has a couple of bits to be added) of all the paper work that you need should it go that far. If it does, just read through it and more importantly the OFT summary at the back, and you will know you will win. so will abbey.0 -
Hello people, I am new to this so please bear with me. I sent two letters to HSBC asking for a refund of £1100 in bank charges, they didn't respond so I have taken it to the Small Claims Court, secretly thinking I would win, however, having had a look on the web today, they have filed a defence against the whole amount, they haven't even offered me anything, so therefore it is actually going to a court!
Please can somebody reassure me or give me some advice as I am now really worried, this month (December/January) alone, they have charged me another £175 in bank charges, although I have now borrowed money to clear my overdraft with them.
