Just found this this on another Thread, may be relevent (as its also Leeds). Maybe some kind of new tactic.
"Barclaycard
Claiming £427.68 inc interest + £50 court Fees
This is the first one i did back on the 30th August, they offered me £180 good will gesture which they credited to my account, even though i rejected it. went through MCOL and took them to court on the 27th September and they filed a defence, so got transfered to local court in Leeds. Im STILL waiting for a court date as the Leeds court say they all bank charges cases are being passed to the "mercantile" court where they will all be heard together by one Judge to possibly set a presedence and they are awaiting High Court direction on when and how to do this. I was starting to lose heart on this one until today........."
Any thoughts?

Question: Back in 1999/2000 got into a bit of financial difficulty. Had a then associates credit card, got in a mess kept missing payments etc. With CAB made arrangement for set lower payments with Associates, however for whatever reasons, late payments, charges incurring overlimit charges, over a 3 year period I incurred £300 in charges,(this is whilst they were supposedly 'helping me').Then another £100 in 2003 to 2005. Now they did freeze the interest on the debt from 2000 to 2005 and it is paid up in full. Would it be churlish of me to now to claim back the £200 in charges that I can from 2002 onwards? Could they claim interest back on the debt that I have now repaid?0

Hi all. Sent my 14 day letter claiming £5700 charges and interest to Bank of Scotland on 11th December. No reply whatsoever so 7 day letter going in post today. Concerned about the risk of High Court action. If I hear nothing in 7 days is it safer to go for just the charges £4800 and do it through the Small Claims process?
Is it unusual to hear nothing at all?
Also, I am still being charged on a weekly basis for returning items etc so there's going to be more to add; can i leave this until the Judgement stage or put it on the claim document?
Thanks for any help, this site is a lifeline. Once I get this out of the way, going to tackle the credit cards.

I followed Martin's advice and sent a letter asking for my default charges, not long after recieving this Lloyds decided to withdraw my overdraft facility, unfortunately my husband lost his job at about that time and therefore made it impossible to attempt to clear my overdraft which was then approx £1500. They refused even if I went under my overdraft to reinstate it demanding the full amount before Xmas. In light of this I contacted a debt agency who send me some useful literature, advice and forms offering whatever I had available at the end of each month (which only amounted to £1.25) Lloyds refused this, however, under the advice of the debt agency have continued to pay this into my account.
Having offered no sort of redemtpion on my default charges I eventually commenced small claim court proceedings against them just before Christmas and they were served with the papers on 22/12/06 meaning they got till 19/1/07 to offer their defence.
Today 4/1/07 I recieved a letter from them telling me they had paid £750 into my account despite the fact I am asking for £2700. I rang Lloyds and said they had no right to pay into my account without my acknowledgement and I was told they could legally do that if they wished.
Its strange but since I initially asked for the default charges, I ve had my overdraft withdrawn, been hassled all through the Xmas period both night and day asking for me to pay it back, and the icing on the cake just after Xmas I went into Lloyds to pay my son who is 13yrs old and always held an account with Lloyds cheques into his account, only to discover there is no record of him ever holding an account with Lloyds.
I do feel like I m going mad!!!!!!! lol
With Lloyds paying in this money to my account do I now stand any chance of winning????
If anyone has dealt with Lloyds would love to hear from you0 -
maniac886 wrote:If it was me i would write a letter back saying that you will accept the £167.50 as part payment and claiming for full amount(court charges+8% interest). They have not stuck to the timetable so its tough for them really! Carry on with your claim for £300+!!
Even though I've already had £27.50 of it back? Would you contact the Court, HSBC, or both? My gut feeling is to write to HSBC and say I want the £195 less the already refunded charge, the interest and the £30.
Thanks for your reply,

Yep, it doesnt matter that they have refunded £27.50 already, remember it was YOUR money in the first place! HSBC did not stick to the deadlines, so you are entitled to £167.50 + 8% stat interest and court charges!"He's a maniac, maniac that's for sure,

Hi Martin - thought I would let you know how I got on.
I have two accounts with Royal Bank of Scotland - a personal account and a joint account, and I listened to your comments on the radio. I have to say I was a little sceptical, but thought I'd give it a go. I put in two claims, using your calculator and standard form letters, requesting £3200 and £624 plus interest for both accounts respectively, going back 6 years.
I dropped the letters in to my branch about a week before christmas, and I have today received an offer in respect of my personal account to repay the charges in full :j . They've side stepped the interest payment but I'm really chuffed.
I await to hear from them in respect of my joint account claim for £3200, but on the basis that they have settled one in full, I dont see how they can refuse on the other - I'll keep you posted!!
So thank you for motivating me to try it, thanks to you I'm £624 better off, and they haven't said that I have to close the account.0
