Hello people, I am new to this so please bear with me. I sent two letters to HSBC asking for a refund of £1100 in bank charges, they didn't respond so I have taken it to the Small Claims Court, secretly thinking I would win, however, having had a look on the web today, they have filed a defence against the whole amount, they haven't even offered me anything, so therefore it is actually going to a court!

Please can somebody reassure me or give me some advice as I am now really worried, this month (December/January) alone, they have charged me another £175 in bank charges, although I have now borrowed money to clear my overdraft with them.

    Many thanks

You now have to prepare your own defence for the court proceedings and follow the steps in Martin's article.

You can claim back the charges but not the interest.

    Hi,

I am about to send a letter to claim money from my credit card for late payment fees, etc.

Can anyone tell me is there a different letter to use for credit cards and if so does anyone have a link to it?

    Thanks :o

Use the same letter just change the wording slightly..

    from a post by nickmark

    You can claim 'late fees'

Just change the text to say 'Late payment penalties' or whatever your Credit Card company words them as.

    Hello all

I wrote the usual two letters to HSBC, neither of which were answered, so I started the Moneyclaim. HSBC acknowledged service and have got until 16 Jan.

The thing is they've now decided to answer my letters, with no reference to the Moneyclaim. I originally asked for £195. Because I got no response I started Moneyclaim so have now asked for interest and a refund of the £30 court fee as well. A total of just over £300.

In this letter, HSBC have offered me £167.50. They state in their letter that this is the full amount, less a charge of £27.50 which they had already refunded. I've checked my statements and they did refund that money.

I don't know what to do next - do I accept the £167.50 or do I carry on with the Moneyclaim? If I did that, they're obviously not going to give me the £27.50 that I already had back from them, can I contact the court to change the figure?

I'd be very grateful for your suggestions, I'm concerned that I've messed it up and I'm going to end up more out of pocket than I was when I started this all off!

    Thanks in advance,

    Clare

    Bank: Nationwide
Amount Reclaimed: £285.52 (inc costs and interest)
    Amount they paid: £252.57
    The story:
Nationwide actually repaid all, I'd duplicated one charge in the claim.:D
Claimed for son after serious road accident and had to deal with his finances.

    Filed 22nd Dec 2006
    Papers served 27th Dec 2006:beer:
    Refund acknowledged 6th Jan 2007:j

    Used Money Claim Online.
  • Bank: RBS
    Amount Reclaimed: 1108 + interest
    Amount they paid: 1108

Sent first letter 11/12/06 asking for charges + interest (1255), got letter this moring 04/01/07 offering full refund of charges (but not interest), which I have accepted.

A real result. A massive thanks to Martin and all invloved in this site.
  • Bank: Lloyds TSB
    Amount Reclaimed: £397 Inc. Interest
    Amount they paid: £547
The story: :j Lloyds TSB have paid up following second letter of complaint and notice of intent to take court action.:j

Even better the claim was for just under £400 and they paid £547 stating "the amount you're asking for is less than the cost we might face in dealing with your complaint if you took it any further".

Many thanks to Martin Lewis and all his excellent work on Money Saving Expert.com :T

If it was me i would write a letter back saying that you will accept the £167.50 as part payment and claiming for full amount(court charges+8% interest). They have not stuck to the timetable so its tough for them really! Carry on with your claim for £300+!!
