  • sent my first letter off to HSBC on 16th December by recorded delivery.
    Have been trying to trace it online, but it keeps saying no info available, so today i finally got through to someone at royal mail, who said they were very sorry but, it was stuck in a backlog of post and hasn't been delivered!!!
    Should be there in the next day or two.
    But now its time to send my next letter.....so what do i do?? wait for them to recieve the first letter or just crack on?! :confused:

    Hi all,

    I am currently trying to reclaim my bank charges from Halifax.

    I read that you can also claim from credit cards etc so though what have I got to lose?

    I sent the first letter off to capital one whom I have a credit card with and the reply I received was as follows:

    "Thank you for contacting us about the charges that we've added to your account. Since you account has been opened on *date* the following charges have been added:

    *List of charges*

    All of the above charges were added in accordance with the credit card agreement you signed when you account was opened. We've also let you know of any subsequent amendments in writing in advance of the change.

    I suggest that if you want to avoid more charges, you need to make sure we recieve your monthly payments on time and make sure you balance doesn't go over your credit limit.

    I am sure this answers your query"

    Does this mean that with them mentioning the credit card agreement, I cannot go ahead and claim back on this account?

    You have to be sure they got the letter and have time to respond before you go on to the next stage.

    When you say first letter is this the letter asking for the list of charges or your initial letter asked for them to be refunded. If its the initial letter asking for refund just go on to the next step and send the second letter.

    Yes it was the first letter asking for the list of charges and they sent the above reply basically saying they were covered by the credit card agreement.

    Are they just trying to put me off?

    I will send the next letter and see what happens.

    hey ppl, after gettin a reply to my 1st letter and offering me £1000, i have now sent them a reply statin that i will accept that payment as part payment and will be following it up still until i get the full amount and they have to reply within 7 days, i'm so happy i sent it, cant wait
  • I'm just trying to find out a bit more about claiming back the 8% statutory interest on charges. Is there a specific bit of law that it relates to? Any info would be appreciated!

    I have two accounts which I am claiming with from same bank, my own one (claiming £560) and a joint one (claiming £480).

    I have gone through the two letter process with both accounts, seperate letters for each account, and on 29/12/06 issued court claim for my account, (£560 plus £80 costs) and 2/1/07 their seven days was up from the joint account 2nd letter so claimed £480 plus £50 costs on that day.

    Today I have recieved what looks like a standard offer letter telling me that £616 would be depoisited into my account in the next few days. However their is no reference on the letter as to which account this settlement relates to, or indeed whether it relates to both claims?

    I wonder whether any others have experience on claiming on multiple accounts and what the likely scenario is?
