i have an account with abby national and i am reclaiming back £830.
after they ignored my letters or said they never recived them i finelly started an online claim, after i started it they sent a letter saying they will refund half the money and they put it straight into my account, this i am sure is not a response to my claim as they then sent me another letter saying they will be defending my claim or i can take half the money, whats going on? what happens when they defend a claim?0 -
You can write back to the bank and say you will accept the amount in partial payment but you are proceeding to court with your claim.
They have to prepare a defense for the court just as you have to.0 -

received advance notice of £30 charge for exceeding overdraft, by £4 for a few hours !
delivered a letter to my branch manager telling him I would follow the advice on this site to reclaim the charges if they proceeded.
charge was due to hit around xmas - nothing so far - success I hope.

I received 6 years of bank statements in the post just before christmas!From FIRST DIRECT.
I have plenty of charges! Namely overdraft charges of £35 a go and excess overdraft charges of around £75 a time!!!
can i demand both back?? or just the charges for excess overdraft?

The story: Followed all of the steps and used all of the letters from this site. Got to the point of "Let's go to court." letter and they offered all my chrges back but not the interest. After spend all that cash (3 x 1st class stamps) I decided to accept their offer.0 -
only the excess the overdraft fees and unpaid referrals , bounced dds etc... not normal overdraft fees .0

I too started the process having watched GMTV. I had the first response from Barclays saying that they would look into my complaint and respond by the 3rd January. They responded by the 29th December. Their offer is a "good will gesture" of £1,000 in full and final settlement as they do not uphold my complaint. Their charges, they say, are clearly listed on their Terms and Conditions. I am claiming back up to the 6 years in full, and my belief is that it could be triple this amount. My husband is so incensed by the charges he draws cash out on his credit cards to put into his current account just to avoid charges! This means that he has little to claim back on. Had he just carried on paying and "be damned" he too could have been putting in a claim for the full amount.
I know it is a personal choice whether to accept or not, but I have decided "not". My fear is that they will close my account and demand back the overdraft in full (£1,750), or merely cancel my overdraft limit and allow me to keep the account open (the effect would be almost the same as I would still have £1750 to find). However, if I stick to my guns and get the full amount, and they THEN close the account and demand the overdraft to be repaid, I can afford to do it. That's my theory.
In my response to them I have politely said that the offer is difficult to assess as they are in possession of the amount they have taken from me - I am not. In the original letter I said I would be requesting statements of charges back 6 years - they chose not to supply these. I am now going to request provision of the statements, or their confirmation of what that figure actually is in reality. I intend to enclose the £10 charge.
Their letter also does not cover what any future penalties are going to be – is it a roundabout we just climb back onto?
I have had my mortgage and insurances with Barclays for 20 years, the mortgage actually finishes in 15 months time, meaning I will be effectively £750 per calendar month better off. How nice that is going to be!
My thanks go to Martin for starting this ball rolling in my mind. I will keep posted on my experience if it helps anyone else.0 -

The story: Been a doddle all the way through thanks to this site. Sent request had statements and cheque returned within 14 days. Sent first letter, got usual brush off 3 days latter then offer of 50% of claim 7 days after that. Called em' up, said not happy with your offer, got a call back the next day with offer of 75%, didn't want anymore hassle so accepted yesterday by post. Good luck everyone else.0 -

The story:
Used the two template letters and interest calculator. Sent claim letter on 5/12/06. Today received letter insisting everything they did is lawful and that they would win a court case, but will make me an offer to save them time and money. Their offer involved subtracting part of my claim that related to arrangement fees for overdraft facilities (fair enough) and they say "I am not prepared to review any additional interest".
Thinking about whether to accept the £1425 or press on, they say offer stands for 10 days.
