Do not sign the letter and return the banks letter. You would be accepting their (very low) offer if you do.
Send the next letter in the process (step 4 of Martins article). Insert the following into the template letter near the beginning............
I cannot accept your offer of £985 as full and final settlement of my claim. I would only accept this as a part payment and without prejudice, but I will continue my claim for the balance.

after i put it in, this is what it looks like.
I wrote to you on [INSERT DATE], making the original request for a payment in settlement of my claim. I cannot accept your offer of £985 as full and final settlement of my claim. I would only accept this as a part payment and without prejudice, but I will continue my claim for the balance. I am writing to inform you I intend to claim the full amount claimed together with interest up to the date of judgment and court fees in the proceedings through the county court.
How does that sound??
also what court should i put? my local court? or Oxford Court?0 -
Try this.............
I refer to default charges applied to my account amounting to [INSERT TOTAL OF CHARGES], which I have requested you pay back.

I wrote to you on [INSERT DATE], making the original request for a payment in settlement of my claim. As I have not received a satisfactory response, I am writing to inform you I intend to claim the full amount claimed together with interest up to the date of judgment and court fees in the proceedings through the county court.
This is based on the Unfair Terms in Consumer Contracts Regulations, as I believe these default charges are unfair and not proportionate to your costs, and therefore the county court will rule in my favour.
I look forward for a full response to this letter within 7 days, otherwise I will commence court proceedings to reclaim my money. How many surrealists does it take to change a lightbulb?

Sent Natwest first letter on November 21st giving 40 days to reply. Sent a £10 cheque with the letter for payment which was then paid into my natwest account which I don't use anymore. Have still not heard anything from them and today is 39th day. Not sure what to do as I know the amount is well over £3,000 for the six year period.
Can anyone help?0 -

Hello
I used to bank with NatWest until I switched to A and L two years ago. I switched because I couldn't cope with their spurrious charges. However, I now want to claim from them and although I have my account number and sort code I can't trace an address for Natwest Primeline Advantage Gold account on their web site, on Google or anywhere else (and of course I haven't kept my statements). I know it's Theale but can't risk sending to NatWest Theale without full address as presumably they'll avoid the 40 day rule if I don't get it to them properly addressed.
Any ideas? (D'oh)
