    This has happened before with Abbey. The Data Protection Act was mentioned alongside who's got yours??!! I don't remember where I saw this - might be on the CAG website.
    I have plenty of willpower - it's won't power I need.

    They also say that in a recent case " Kissick v Citifinance" The case was dissmised and the court implicated that the policy of charging £12 for fees was a fair one. This letter was also written by a solicitor.

    My question is should I take the next step and take them to court?

    Yes, take them to court. There are a couple of points about the "Kissick v Citifinance" case that you should be aware of. First of all, this case is under appeal at the moment, so there is no guarantee the first decision will stand. Secondly (and more important), a judge has already ruled that this case is not applicable in England because the law in N Ireland is different.

    Some of the banks are returning the £10 cheque and not charging so presumably this is Nat West's way of refunding you the £10?

    Orginally applied for my statements (DPA) back in August... was offered £400 after first letter declined and commenced with court action 29 Nov... checked my account on Friday to see that £2126 had been paid into my account... still no letter from the Halifax yet!

    Thanks to all that have helped including BIG M :money: for his orginal inspiration... stop thinking.. go do it!

  • I've just sent my first letters to Barclays and Halifax today. In my haste I neglected to send them recorded. Would it be worth me cancelling the cheques I sent with these letters (10UKP each) and sending the letters again or is it unlikely at this stage that the banks would/could stall or even claim that my letters didn't arrive?

    Has anyone else made the same mistake that I have and had problems? Or has anyone made the mistake and had no probs whatsoever getting a reply back?

    If at the end of the 40 days I've had no reply I guess I could start the process again...

    I didn't send the letter recorded - didn't think at the time. Didn't have any problems so wouldn't worry too much about it.

    Also didn't send initial letter recorded :mad: - that didn't enter my head either!

    It was pretty easy sent of the standard letter got one back saying the charges are fair but they will be reviewing them shortly and a cheque for the full amount will be with me shortly. It was all to easy.
  • Barclays provided the last 6 years statements free of charge
    I asked for £200 to be refunded and they offered me £120 which I accepted

    hi all, received a letter yesterday from first direct (I sent them letter last Friday asking for charges back giving them 14 days) their letter said they were sorry I had a complaint and would deal with the matter and I would hear from them within 10 days - is this the normal response letter they send while getting my cheque together?!?! I am really keeping my fingers crossed I get a cheque just before xmas...! wishful thinking perhaps but I am an optimist!
