    Hi
You need to start the Court claim now then. You can do it online at https://www.moneyclaim.gov.uk/csmco2/index.jsp or you can do it in person by taking your claim forms to court yourself.
I don't know if there is any information on here about the process (I'm sure there will be somewhere) but if not try: http://www.consumeractiongroup.co.uk/forum/ there is a step-by-step guide on there.
    Good luck!

Halifax - Wrote on 30th November giving them 14 days to reply in full to all bank charges, have received letter dated 6th December stating that it has been passed to their Customer Relations Department, have just telephoned and they have said they have 8 weeks to look into this and i will not hear befor the 8th January are they correct in what they say if not what can i do?

Did they say in their letter that it would take 8 weeks or was that only said in your phone call. Always better to write rather than phone.

You can now write back and say you are going by your timescale and will now be taking them to court and won't be waiting for 8 weeks.

  • Amount Claimed £6,100
    Amount Paid £6,100 plus interest
Sent initial letter as per your template. Standard reply- No.
Sent next letter as per your template with all charges shown and interest charges calculated (thanks for the calculator it's invaluable).
Offer of 2K full and final settlement so declined.
Sent last letter 7 days before action. Standard 'no ' reply letter back.
Applied to Court and filed papers.Waited 14 days.
Fifteen days rang court - Halifax had not replied.
Filed Judgement papers, however court resent papers so I thought Halifax was going to defend. They had 28 days to 28 December. Today 11th money in my account:j :T :A :T :j Thank you so much Martin. My four children will now have a great Christmas.

  • Bank: Lloyds
    Amount claimed £520
    Amount received £520
Sent all the letters as per consumer action group. Proceeded with court action, it was defended. Got to the date setting point, when received two letters in same post, one threatening to go ahead and one to settle. They settled.
  • I am in the middle of trying to reclaim my citi visa card charges of £425.00. They have sent a letter back offering me £161.00 and saying that if I am not satisfied with this they will defend this claim.
They also say that in a recent case " Kissick v Citifinance" The case was dissmised and the court implicated thet the policy of charging £12 for fees was a fair one. This letter was also written by a solicitor.

My question is should I take the next step and take them to court?
  • So I received a letter today offering me £98 haha!

I think they missed the 1 before the 9 and the 0 after the 8.

I was thinking of saying something like "I would be willing to accept £1508 in the form of the immediate payment of my outstanding natwest loan at £1008 and a payment of £500 into my account".

Or should I just send the standard letter?
  • Wrote a letter to Natwest on November 20th asking for the amount of all charges over 6 years along with a cheque made out to Natwest from my new Abbey account. I sent the letter by registered to my local Natwest. A week later the cheque I wrote out for £10.00 was cleared into my Natwest account. I gave them 40 days to reply but can't understand why the £10.00 was paid into my natwest account.

    Can anyone help
  • hi looking for some advise on what to do next, I sent the letter, requesting our bank statements for the last six years, which they received on 31.10.06
They sent me a letter which I received on the 17.11.06 stating that they would send me individual duplicate statements for the last fourteen months, stating that previous transactions had been archived onto microfiche, and it would not be possible to send out a computer print out but they had made arrangements to send a list of archived transactions under separate cover.
they also stated that they cannot give me any details about any manual interventions, has these are not always recorded.
I have since received four statements and a list of transactions dated from the year 2000 to 2005. upon looking through the list of transactions part of which I cannot read, they are not our duplicates of our statements so I have obviously been sent out someone else's list of transactions. I am unsure of how to proceed, the 40 days were up on the 10.12.06 but I have been experiencing difficulties with my internet so have been unable to ask for advise earlier. any advise of what to do next would be great thanks.:o
