Halifax had acknowledged after I'd completed the Moneyclaim forms online.

Now they've written to me saying that on a purely commercial basis, and without accepting liability, they're going to pay up in full on both of my claims against them (1001.71 including interest and court costs)!

I'm so thrilled and it's thanks to this site and the CAG site.

I start Moneyclaim against HSBC on Tuesday if they don't reply before then .... roll on!

Thanks to everyone who have answered my numerous questions!

  • Tomorrow is the 14th day since i started my moneyclaims against Lloyds TSB(£2600 + costs) and Barclaycard(£214 + costs)
. Neither have responded to it, so can i call for a jugement tomorrow or am i best waitin till Monday to start it?
Has anyone else been in this situation, where the banks have not responded to it and have the judgements gone in the claimants favour?
    Any advice will be grateful!!

    Bank: Halifax

    Amount Reclaimed: 130 + 689 (two claims)

Amount they paid: 130 + 689 plus interest and costs on both - total = £1001.71

The story: I wrote the two standard letters and then commenced Moneyclaim. To my horror they acknowledged service which is when I started to panic a bit, but half way through the allowed period, they wrote to me saying that although I accepted terms & conditions blah blah . . . . it would cost them too much commercially to defend this, even if they won . . . . so they'll be sending the money to my bank accounts within a week . . . . not accepting liablity. Don't care what they're accepting, I got my money back!

A Very Very Happy Clare! :j

I sent off a letter to Lloyds on 30th November (£1458). I haven't heard anything yet and didn't expect to. Is it 14 working days to wait before the next step can someone tell me please? Thanks :)

Just to add I didn't include interest charges with it. Not sure if that was a bad thing or a good thing  .

Admittedly my claim was very small, but several weeks ago I wrote to Amex about a late payment charge on a Blue card from back in April 2004. I had cancelled the card no more than 6 months later, but I now have a different Nectar card with Amex. Within 2 days of my letter I had received a response saying that the matter was being investigated and I would hear back from them within 28 days.

This morning I checked my Nectar card account on line, and they've credited me the full amount that I asked for. I only sent them the first letter, so this was quite a surprise - I expected to have to send a follow up letter before action at least! The charge itself was £20, but I had lumped the interest that they'd charged me on top of this, plus interest of my own on the total at the standard rate of 8% (used the calculator on this site). The total that I had claimed was £25.22, and this is what they've paid out - just like that. I am now awaiting their letter, as I haven't received anything in today's post. I really am quite shocked and interested to hear what they have to say now.

The information and advice on this site is invaluable. Thanks to Martin and the MSE team, as well as all of the other people pushing this issue on other sites like the Consumer Action Group.
  • I asked Halifax bank for £764...They offered £330...I refused.

Started my money claim last week. (Very easy to do)

They said they would defend the claim.

Yesterday they paid £995.83 into my account....not much of a defence but hey i'm happy:j

Big thanks to Martin and all on the site who spurred me on to settle for nothing less than all they owed me. The banks do not want to defend this in court...take it all the way they will fold before a court date is set

Well done if your tenacious enough its easy. I have had £880 from Halifax £230 from Lloyds TSB and am awaiting a letter Monday for £880 from Citibank.
    It pays to challenge
  • Its 14 days. There is an option on moneyclaim when you are putting together a claim to ask for interest or not. Hope i've been of some help Lara. I'll keep you all informed as to what happens when i ask for a judgement on Monday. No post today!!!!
  • Hi

I have sent an letter to Abbey for the records of the last 6 years. They replied that they will sent me the last 14months of statments because the rest are in microfilms.
Few days later I have received that last 7 months of statment (up to the day I closed my account with them) and calculated the charges to £670. For over a week now I have not heard from them.
How long do I have to wait for them to sent me the records (statements).
Also all the years I had the account overdraft I was charged ~£12 interest per month for £1900 overdraft. At the last month I was charged £50 for the same amount. Is anything I can do about it?
I have calculated that the years before I have been charged between £100 - £350 a month. Is it any amount limit on what you can claim?

    Thanks
