Having been ripped off for £720.00 by Lloyds TSB in illegal bank charges, I wrote to my branch asking for refund. Negative response. I wrote again (as per the templates on this website) but again it met with a negative response. I then issued a summons via MoneyClaim Online for the £720 plus £80 cost of summons. Two days before the 14 day deadline for acknowledgment of service, the bank's solicitors lodged their acknowledgment of service with the court. As soon as the 28 days was up from when I first took out the summons against them, as they hadn't lodged their defence, I obtained a Judgment by Default asking for immediate payment. Fifteen days later and still no sign of the money, I sent them a fax saying unless the money was paid in full into my bank account by close of business that same day, I would issue a Warrant against them and send the bailiffs in. Still no response and no sign of any money! The following day I went on to the Moneyclaim Online website again and applied for a Warrant of Execution to be carried out by the Court Bailiffs. It cost me a further £55. I then prepared my own Press Release ready to submit to my local newspaper and the Nationals. Two days later (and just one day before the Bailiffs were due to go in and seize goods or demand the money, which by now had increased to £855.00) £800.00 appeared in my bank account! I am now applying for the refund of the £55 and if I can't get it back from the court, I shall be after Lloyds TSB for that too!
I am delighted with the result and my sincere thanks to Martin for making it so clear to an ordinary member of the public like me, to claw back money these major financial institutions took from us illegally in the first place! Thank you Martin!!!0 -

The story:
Once Barclays sent me my statements I wrote to them for my money back. They offered me £500 which I turned down. I wrote to them a few more times (always sending via recorded delivery) to give them opportunity to settle out of court (I thought a judge would look kindly on me if they could see I had made a real effort to settle out of court!)
Barclays didn't reply to any of my letters (3 in total after I rejected their offer) so I went through MCOL. The Bank acknowledged my claim. Then, at midnight on the final day, I checked MCOL and no defence had been filed so I got all excited thinking that was it! I'd won! Unfortunatly, they submitted a defence before 4pm the next day so my excitement was shortlived!
I filled in my allocation questionnaire, received my court date, and then prepared my evidence. It took me ages because I wanted it to look professional and not miss anything out.
Then, two weeks before the court date I had a phonecall from Barclays saying they wanted to settle! I couldn't believe it! They faxed me across the offer, I signed it and sent it back, the money was in my account the next day and I cancelled the court hearing.
I am so thrilled as the money has been used to pay off some of my debts. :T
I will be forever greatful to the help and advice I've had from this site. It was a hard slog as I started the whole process in September last year and got my money this month - but it was all worth it in the end!
Now I've just received the statements for my Barclaycard so am starting again!

Followed all of the advice on this site, took 3 months altogether but they settled just before I was due to start court action. Initially offered a "goodwill gesture" of £150 but settled when I refused to accept it!
Thanks Martin, I was starting to think I wouldn't be getting anything back from MBNA.
Still waiting for 2 more claims to be settled with MBNA. Yorkshire Bank have just filed a defence so we'll see what happens with that one!!!

Amount repaid: I've just received a letter saying they will pay all charges in full.
Initially they messed up all my direct debits making me overdrawn. I tried phoning but they never answer. I sent a letter of complaint asking for a refund and they sent me a condescending letter more or less telling me that they know best and there's nothing I can do about it. Grrrrrrr!
Even after I threatened court action (thanks to MSE template letters) they still refused to refund the money. But once they got the summons they changed their attitude completely.
For me, it wasn't about the money, it was the injustice. I would've gone to court for a fiver.

HFC/Household bank have paid up the full £315 i was claiming, i said i would accept this without the interest which would have =£417, but not really bothered about the interest, just glad to have got some money back from an acount i thought at first couldn't because as the title states it was a flexible loan.

First Direct have agreed to settle for the full amount (excluding interest) I claimed - £385.
Sent off letter on Tuesday, they sent out their offer the next day.

I cannot believe that a couple of letters and a pleasant conversation has resulted in a full pay out.
Natwest, initially stalled when I requested my statements, said they had been sent out. I complianed to the ICC and the statements arrived in March, I originally sent the letter in November.
I sent back letter 1 with a list of charges on 2nd March, heard nothing, sent letter 2, made 1 phone call, spoke to a great member of the Natwest Customer Relations team who said I should hear a decision around the 18th May, I heard on the 24th May. Not bad really.
The staff member at Natwest couldnt have been more helpful but a HUGE thanks has to go to Martin, if it hadnt been for you gesticulating wildly on GMTV I might not have sat down to watch the slot and I wouldnt be £5,504.00 better off, and seeing as Im the big 40 a week today, the 1st, I shall be having a fantastic birthday, with treats for the family.
So thank you Martin and this sight for keeping me informed and it has to be said, with some of the posts, entertained.
