Bank: Abbey
Claimed £4300
Recovered £4700 (inc court costs)
Took it all the way to the wire, went to small claims court, filled in forms etc, sent off questionaire, even got date back for hearing, then got an e mail from Abbey asking if I would consider a settlement, phoned them up and agreed on the ammount after getting them to increase the offer.
Dont let the banks bully you into submission over the case Lloyds won in Birmingham it was a very rare occasion and they know it.
Now working on Nationwide buts that only for £30, still all the worth while.0 -

I recieved another letter this morning from Capital One. The usual about the fees NOT being unlawful and whilst they do not accept liability and in an effort to resolve the matter without the need for a court hearing they are arranging to send me a cheque for £284.73 as they have already given me one for £78 that brings it to £362.73.
Not bad considering that I only claimed £323.73 from them!!!!!
The letter goes on to say "I hope that I have explained things clearly for you and we can move on from here. I would finally request that you contact the court to congirm the settlement and discontinue your claim. This is very important as it is your responsibility to inform the court that your claim is settled and avoid wasting any further valuable court time. We have also writen to the court to confirm that we have paid in full".
Can you believe the cheek of some people! If they had given me MY money back like I requested in the first instance then I wouldn't have felt the need to take them to court! Furthermore I will NOT be telling the court anything until the cheque finally drops through my letterbox and is firmly in my hand and I wouldn't trust them as far as I could throw them!!!
Now that I have gotten that account sorted out I will get back on the phone this morning and try to hurry the others along too!

Barclaycard £993.55 - Initial payment of £376 still after the rest!!!

papers are being drawn up by our lawyers as we
speak so hopefully it shouldn't be long now!!!
That brings the toal that we are claiming back to £9694.43, if we get it all we are adding another bedroom onto the house so here's hoping!!!!!!!!!!!!! happens!!!:D0 -
Bank: Lloyds TSB
Amount Reclaimed: £80
Amount they paid: £118.51 (inc court fees + interest)
The story: Well, I started my claim in Jan this year, and they contested all the way until about 3 weeks before the court date when they settled. I received a partial settlement of £80 midway through the proceedings, but since I had already filed my claim I wanted it to include the court fees so rejected it.
Interestingly, I had the same judge assigned to my case that was responsible for Lloyds TSB's recent 'win', but I wasn't worried. Unlike seemingly most people on this site (including Martin!) I could see that his judgement was perfectly fair for the case, since the claimant hadn't provided the court with a copy of Lloyds TSB's T&Cs so he had no way of knowing whether the claimant had actually been charged for a breach of contract, so all the relevant laws and precedent cases didn't apply.
So yeah, as long as you read up on this stuff and create a decent court bundle you have nothing to worry about!0 -

Amount Reclaimed: £3608 / £4622.83 with Interest
Amount they paid: £3563.00
The story: Wrote initial letter asking for money back. Got standard letter syaing they have an 8 weeks waiting list and to wait, didn't wrote next letter stating they had 14 days to pay or i'd take them to court. Recieved letter about 20 days later not admitting guilt but as a good will gesture they'd pay back £3563 by cheque (my account is LONG closed), which is my claim minus some packaged account fees apparently.
Writing back to accept today!

Now... to sort out my Llyods TSB claim (sigh!)

28th April - Daughter wrote to First Direct to ask for bank statements
8th May - Received letter saying the statements will arrive by courier
17th May - statements arrive
18th May - letter sent to First Direct claiming £280
Today 22nd May - letter received offering full amount
Today - letter sent back accepting offer!
Not a lot of money compared to some claims but a fortune for a struggling student!

Went all the way to court date. Two days after sending court bundle, received offer of full settlement. Advice is send court bundle early - due to work constraints I took 19 days to send my bundle in, offer quickly followed..Lou0 -

YEEHA I have just come back from a holiday and much to my delight my bank have given me back all my claim (bar £2.00) I had taken them to court and was awaiting the final days of the acknowledgement period and they caved in!!!!!!:rotfl: :rotfl::j :j :T :T
as you can see I am not that bothered about it!!!:D The bank in question is the Nationwide and I am now £939.47 better off thank you.!:j To all other people claiming dont give up and keep on they will cave in the end. GOOD LUCK to you all who are still awaiting the out come of their claim..

Bank: Nationwide
Amount claimes: GBP 33
amount paid: GBP 63 (including court fees)
Story: Nationwide returned a direct debit in November. They did it, but didn't tell me, and so I paid interest on a credit card, a fee for doing this etc.
I complained, and they just told me it was their 'policy' to charge and return direct debits. They said they were contesting the claim when I went through moneyclaim. I was shocked, thinking this was bad. One day before the court ruling, they wrote and said that their 'defence' was they had paid me already! They had done so 30 minutes before sending their 'defence'! I still don't understand why they delayed so long before paying out. I was reasonable about it, writing to them etc. But they were stubborn and I had to be strong.
Moral of story: keep going, because the bank thinks you will give up! But they pay in the end!

They wrote to me within the requested 14 days and said they were investigating and I would have a response with in 4 weeks which I did and they paid up.
So pleased, thank you to you and your site for letting me know that I could get this money back.0 -
I asked for £2,600 in charges to be refunded and received £1,985.
I had to wait the full 8 weeks for my response (this is the time banks are given to respond) but I was given compensation of £25 for having to wait the full 8 weeks. It did require patience and about 4 chase-up phone calls but it was well worth it. I decided to accept their first offer because it was not worth chasing interest. Don't be put off by delay tactics or anything because I was told they had to reply within the 8 week peroid and they did. I wasn't told to shut down my account or anything.0
